Hustler: We Will Fight Infringement of Our Trademarks on .XXX

BEVERLY HILLS, Calif.?Hustler has issued a statement saying it remains unrelenting in its stance that ICM Registry is prohibited from registering or selling to a third party any .XXX domain names that contain the world-famous Hustler trademark or other Hustler-related trademarks. The company further stated that on more than one occasion, it has made clear in writing that any attempt to do so will constitute infringement of its intellectual property rights and that legal action will be taken.

First with Manwin, now with Hustler. These are some of the biggest players not on board with .XXX. Wheres the sponsored community?

Mr Flynt used to live and breath for these "silencing of speech" fights. Most importantly the man has the fucking money to defend itself from these parasitic leeches.

Ofcourse, who knows whats really going on behind the scenes. But hopefully, some of the bigger companies will not give into the .XXX lobby. At least so far, it looks like their not.

The beauty of this is that if even 12 big companies step up and do the same that Manwin and Flynt are doing you suddenly have 12 big ass lawyers whittling away at the .XXX lawyers who are finite.

.XXX will simply not be able to sustain the battles, far too much legal $ over a period of time whereas the individual companies will continue to attack them with ease.

Now you might think that these companies just want their .XXX names protected, so they would be willing to let things slide if ICM said okay, we will not allow your domains to be sold and they make a deal.

But I believe that would establish precedent so once they acknowledge that they must protect those trademarks its all over because any companies will beat them again and again all the way down to the last trademarked domain name and ICM will lose untold millions upon millions of dollars.

If they succeed in protecting their name and trademark. So will everyone else and .xxx is dead and buried. Good news.

Quite right too.

I'm not so sure it is as 'fucking sweet' as some people think it is. I get the impression that people think this is showing some kind of lack of support for .xxx, when in reality it is not. It doesn't mean anything of the sort.

Initial regs - yes. Yearly rebills - no.

point being is that their business plan is unsustainable. after a year they will be fucked with no recurring on trademarked .XXX's while many companies will still be suing the shit out of them.

imagine being tied up in courts for a few years with multiple lawsuits, the money is flying out the window faster than you can make it...

.xxx will likely try to play games with smaller brands in the hope of setting precedent before confronting top tier companies like hustler.
Still, it's nice to see Hustler protecting it's property proactively like it always has.

99.9% of our industry doesn't own a trademark on shit.

Reality is, they don't have to worry about much... even if someone registered the domains, it's not like you're going to win against the registrar that takes it down. If you jumped in and sued the registrar, it wouldn't make it to court, if you forced it, you would lose like everyone else - assuming they do respond.

This isn't rocket science... Flint is doing his marketing thing, that's it, even with his trademarks, the threat is weak.

Hustler and Manwin are not doing this to save $60 on a domain. I don't see them acting on what is best for the community but as posted on an earlier thread everyone is on their own when it comes to ICM.

Yes Mr Flynt used to be an amazing first amendment warrior for sure. My respect for him and his company took a hit back when Acacia was doing its thing and hustler and Vivid cut deals though. I am over that now.

I don't care how big of a business I had if it concerned adult and Hustler tried to contact me I would definitely NOT ignore them
Quote:
Attorneys for Hustler also said that they continue in their attempts to initiate a dialogue with the registry, but that ICM has remained silent. ?We are constantly policing the registration and use of domain names that attempt to capitalize on Hustler?s trademarks,? said Jonathan Brown, attorney for Hustler. ?ICM?s silence is particularly disconcerting, especially in light of ICM?s supposed aim of ?working proactively to balance the rights of? existing domain name holders, and other trademark and intellectual property holders.??

?Unfortunately, despite all the talk out of ICM, it appears that the .XXX TLD will do nothing but drive up costs to the adult community and will force us to fight infringement on yet another front,? Klein added.

Anyway, Hustler would have the same success trying to sue godaddy. ICM's legal out is the sunrise period and Hustler, as mentioned, just riding the publicity.
This is an entirely different animal, .XXX an adult TLD.
you really think if the govt says eventually "all adult sites on .XXX" that some jerkoff with Hustler.XXX is going to to anything with it?
the point here is that ICM is going to either bow to the wishes of companies like Hustler and Manwin or they are going to get slaughtered in court on trademark infringement.

at net $70 or so per domain registered, they will have a lot of money to fight legal battles for the forseeable future.
