That's why they file against Doe's, which are treated as placeholders. Upon discovery they simply substitute their names. They don't need to refile with the court and start over.
With 100 Doe's as individuals and 100 Doe's as corporate entities that's a lot of advertisers, ISPs, CEOs, CFOs, CTOs, and other individual stakeholders. Even if the actual owners are non-suable, the case against the Doe's can continue.Comment

Private seems to have found a formula to systematically go after the tubes.
BTW just cause the guy may or may not be in the US doesn't mean you don't want to defend yourself against a default judgement. I bet there is some way to use that against the owner in terms of domain ownership or hosting.
