This has been nagging me for a little while. What would you do if someone refused to pay you, except for a token, and then became very difficult to communicate with?

I have been owed money by someone who will remain un-named. (Nondisclosure clause, which I don't intend to violate.) When I try to contact them about it, something always comes up. We're talking a few grand a few months late.

What would you do? I have been sitting quietly and waiting for the reply, but bills are going unpaid. Any nice solutions you can see?

No but seriously, I would pay them a surprise visit and demand the money back. If you sit back and wait or if you're really polite about it, they will step all over you. A few grand? I'd be pretty pissed off if I were you !!

Got contracts/documents that prove he owes you this money? Sell your dept to a collection agency, that's what I do every time some degenerate online gambler tries to fuck me out of money. You don't get all of what you're owed, but if it's really becomming a pain in the ass, sell the dept and then it's the collection agencys problem. Plus if he doesn't pay up, it fucks him over credit wise.

Interesting thoughts. I haven't worked with collection agencies before. I suspect this is a bit complicated for that, but I guess I should keep it in mind.

Has anyone here ever gotten contract pay that took some effort? If so, what worked for you?

The NDA was actually a separate agreement, so the two wouldn't void one another. However, even if it did, then once I bitch I wouldn't be able to get paid (by the reverse logic). Ian, if you remain passive about money you're owed you'll never get it.

Sometimes you need to go for their balls. If someone doesn't pay you what they owe you and continuously avoid you, leave your passive side at home and hunt them down.

YOUR bills aren't getting paid because of THEM. Fuck them. They need to pay up. Once someone starts to have a negative impact on your life, all niceties should be thrown aside.

I am too nice. I guess I will call the home phone numbers I shouldn't call, and get a letter from my lawyer. I was just hoping people could pay me the money they promised me without me having to fight for it. Maybe I am too positive about human nature. I think people are stupid, but don't expect then to be malicious.

Easier said than done. Even if I wanted to go after them, what could I actually do that would do any good? Kindof hard to take a US company to small claims court from Yorkshire... When I try to talk to them, I get ignored, I get the runaround. Doesn't leave a lot that I can do-- Which leads me back to the original question. What do I do to get my money?

The way I hear it, you were fired for not doing what was expected for your set amount of pay. I employ about 20 people full time, if somebody is not pulling their weight, I fire them - plain and simple!

The bitch about working for somebody else, is that they will always expect at least 150% out of you. If you are only giving 70%, then your ass is out the door. Good luck in trying to collect a dime. Become self employed - then if your lazy ass does not want to do anything and you fail miserably, you have nobody to answer too

I do not know what kind of agreements UK has with the US about this type of things, get your lawyer to check them out while he is writing them a letter. But first call them at their house and just be frank about what you will do if the money is not paid. My guess is that the lawyer will also suggest a collection agency since that is the cheapest way to obtain money that is owed you.

If you haven't been paid I am not quite sure what clause you would be violating. Once someone starts avoiding you that's it. You're not going to get your money unless you step it up a notch. I used to do "street" collections in NYC so I know what I'm talking about. If you want your money you're gonna need to take it. Legally (i.e. collection agencies or lawyers depending on the amount owed and whether it is worth it) or by force (I'm being serious). I think the first option sounds better in this case.

All these vague "someone owes me money" posts... It's no wonder people are holding back. You guys won't even out people who owe you thousands of dollars?! At least tell us what country or if in the US what state this jerk off lives in and maybe someone can guide you better.

This is not directed at you per se it's just that this passive "I don't want to mention the name but can you help me" is becoming a trend on this board and that right there shows why the person is not afraid to blow you off.

I wish I could help. If the person is in NC I will... What's the deal???

Where did you hear that, exactly? If you like, I can send you a copy of the contract. I have not been challenged as having failed to comply to any clause in the contract. Rather than seeking the recourse included in the contract, the other party has simply withheld both payment and communication.

What do people here think... If you have a contract with termination cluases, can you ignore them and decide to bail out and not pay?

Up until this comment by someone I don't even know, I assumed I would be paid eventually. This makes me think someone has been blabbling, and that I really am screwed.

It's kind of the industry standard.. You can get just about any club to collect for you and that's what they will take.

Call him up. Make sure you're really pissed off before you call. Bitch him out. Tell him if he doesn't pay by Friday (the money MUST be in your hands by Friday) you will be seeking out other methods of collecting payment.

You have from now until Friday to decide what you want to do. See what the International stipulations on collection agencies are. I have never used one so I have no idea how they work.

If that doesn't work, call your lawyer and see what could be done and if it would be worth it. If so, go for your money. If not, you take the final option.

The NDA, being a pretty general and standard one, might be taken to cover just about anything. The last thing I need is to lose income because I said too much. Plus, I would like to give people a chance to do the right thing before I publicly slam them.

Yeah. I can pay my bills without a hassle... usually. Until I don't get paid for something really major (for me, I mean) for three months. Then the system kinda falls apart. So far, the bills are getting paid, but the credit card is bulging to make it happen, and we're eating a bit more rice, so to speak.

I don't want anyone to assume anything here. I don't want to spill the beans, I am not at that pointyet. So I won't confirm or deny any one program. I will only say that I have done a few transactions on this scale in the last 6-months, so don't assume this is what you think it is. After all, that would besmirch anyone I had worked with, and obviously they aren't all crooked. ;)
