One thing to Remember. If you go to sue them or any litigation the Labour board says they will not help. So talk to a lawyer see what he thinks. the Labour board is Pretty slow gettign things done it seems right now but they get to it.

i get mortgage guys asking me if they can generate leads online...im sure car dealers are the same....fuck salesmen...deal with the owners of every car dealership

Sorry to hear this man...Saying sorry feels so trite...I know exactly how you feel... Was handling a department when the powers to be wanted me to train some people from the US office so that they could jump in to do my work when Canada was on leave....Guess I taught them too well when I was fired after I trained those people and gave a +report about them a month later.....Though I did get my ROI....

My suggestion....Call the labor board. And you are definitely eligible for EI since you must have worked more than 600 hours in the last 8 months. Know all this coz I researched all about it. Feel free to hit me up if you want any more Info...

Seriously, you come here for employment advice?

1) Find out what the terms of your layoff are. I'm going to take a guess and say that its, no severance, nothing, but they are giving you two weeks working notice while you train the girl.

2) You don't have a job description, so its perfectly acceptable for them to ask you to train the new person.

3) Don't get an overblown sense of your own importance. She *may* not be able to replace you, but there is *always* someone who can and its always easier than the employee thinks it will be.

4) Start putting out your resumes right now instead of crying on GFY.

5) Dont burn bridges at the current place, for so many reasons. One is EI. The other is, get a good reference letter, now. And I would secure your Record Of Employment form from them right away if possible.

6) You don't have a case for wrongful dismissal or any of that jazz, so just put that out of your head. [unless there was some very HUGE part of the story you left out].

And, once again, can I just say, this is the worst possible place to be getting advice from.


Beyond that, I'm curious. How were you generating leads? Craigslist? Or a dealership website.

I am from Ottawa, Canada.

If you were fired, no EI benefits. If you were layed off, then yes you get EI. However, you should contact EI regardless and when you apply it will ask very specific questions. If they see something fishy they will go after the company themselves and get you mucho mucho benefits if protocol was broken.

As far as I know, In Canada, they cant eliminate your position to keep another employee who thus takes your position if you are meeting all expectations and past the 90 probation period.

Why don't you ask for her job in the meantime? Sales are not hard and you could end up doing better than her.. 80k as a top earner is actually pretty weak if the dealer offers on-site financial services. In a market that size a good top earner can do 200k

Then move on.

Ignore advice about "revenge"; they will know immediately that it's you and
you will go straight to jail.

Fuck collecting unemployment, go straight out and find another position like you
are leaving now. Otherwise you will start getting those unemployment checks and
lose track of time and then the checks run out and you won't have the level of
biz that you need online.

You are playing with "murphy's Law" when you accept unemployment.
That shit will go wrong.

today was an interesting day at work.. it was the girls birthday, she went into the office with the manager and told her that she doesnt want to do my job, she was told its a full time job and its alot harder than she thinks.

Im not sure whats happening now, but I am guessing they will be asking me to stay.

btw.. to the reply above.. Im not crying at all, thou if you knew the history of my position and how hard I fought and presented myself to get in the door presenting reports after report to move up from min wage.. I starved for months before getting a decent pay, and I was still in the process of getting paid a % for each lead on top of my salary. all the struggle to get to the top only to be taken away in a heartbeat kinda gives me a good reason to cry, the reason for this post was because I wanted to know if what they did was even legal, and if I was entitled to anything and how to get it incase I dont find a job quick enough.

btw the main boss asked me how I was feeling today and I just said I am fine, after ripping Anthony apart when I quit/he fired me whatever it was, I learned from that mistake.. no need to burn bridges.

I did delete her from facebook.. oh that felt so good hahaha

well it been less than 24hrs since I found out and I as well as my manager and an internet manager at another dealership has been putting the word out that I am available.. so the word is out.. don't worry that was my first choice before coming here to cry :)

thou id rather work online again.. I am thinking about going back to school to learn some programming so I can build some better sites on my own and generate my own leads :)

Well I doubt that is part of your job's responsibilities... charge them consulting fee to teach her and head over to the competition for an interview.

Just take her through the motions, how to take pictures of the cars, enter the data into the website etc. Do not show her how you market or generate leads.

First of all they undervalue what you do thinking that they can throw anyone into the same position and get the same results. She will very likely sink and their sales will go down.

Try finding a job with another dealership in the mean time. If you leave on good terms you almost guaranteed a call back in 2-4 months from them looking to hire you back when she flops. Which if you don't have another job yet you might want to take them up on it, at a higher pay of course since they would now value you a lot more.

I would show her 1/10th of the job so she thinks, wow, this was easy! Then the shitstorm starts after you are gone.

Next, don't quit. Get fired so you get unemployement. While on that continue doing what you were doing... Only for a different demographic (America) and selling the leads to online car companies like CarMax.com...

Or do this same service online. Do it for 100's of dealers...

Laws are different place to place but Ontario has good ones. They RARELY can fire you and replace you with someone else without just cause.

You will have to go in for the 2 weeks otherwise they can say you quit and you'll have no chance at EI.

But just call the labor board to be sure.
