So why not, in light of legal perspective, try to undermine the un-authorized content at the root level by working with them? The benefit in the long run outwieghs the downside, if you ask me. Control of your brand. Increase of Traffic. Profitable partnership. Compared to endless DMCA hell. Loss of brand recognition. No traffic. No income from content.

Everyone is free to stand on principles that have and are being adjudicated constantly. As business owners, we have to stand on that wobbling surface of legality and figure out how to be profitable given the circumstances.

The first dictum I learned in this business was that all traffic could be profitable as long as you optimized/filtered/geo-targeted/marketed wisely, you could always do something with the eyeballs hitting your links. imo, the people that will thrive in today's intellectual property landscape are the ones that best understand that and can take advantage of it.

I think the crux is this- they could do, they just won't. There are measures a company with 300 employees (give or take) could easily implement to proactively police the content hosted on their sites using the same staff I would assume they currently allocate to insure they don't host any videos showcasing illicit sex acts (cp, bestiality, etc)- the key is they have to want to, and frankly that is not in their best interest.

The bottom line: until the law is changed manwin will continue to do the bare minimum required and claim they are making their "best efforts". For them to pretend they give a shit or for us to pretend they care is just silliness. :2 cents:

The issue is that as much as people hate hearing it - the tubes are not "illegal" and if they are considerate to take down content in reasonable time then they are operating "lawfully". So that means it is less like the mob, and more like say... the electric company. You can opt to go off the grid and generate your own power, but working with them makes more sense for most economically speaking.

Can't speak for today other than the remarkable feat of users who have only been there a few months having 1000s of uploads, but people did fully connect the dots when they were still Mansef and their people were uploading videos to Pornhub.
