FSC Presenting a Panel on .XXX at Internext

I just wanted to give everyone a heads-up that FSC will be presenting a panel on .XXX Sunday January 9th from 12-1pm.

The delay of decision concerning .XXX by the ICANN Board in Cartegena, Columbia on December 10th has generated a number of questions. What are the issues of concern for ICANN? What happens next? What are the implications for adult businesses? What can we as an industry or you as an individual business do to fight a .XXX "sponsored' TLD? These questions and more will be answered by panelists who know a great deal about the issue. Industry attorneys Al Gelbard and Greg Piccionelli will share their expertise as to the trademark implications, FSC Board member and industry attorney Reed Lee and I will discuss FSC and overall industry efforts. Finally Matt Zimmerman from the Electronic Freedom Foundation will discuss the censorship red flags that arise with the proposed TLD.

.XXX may be something most people here don't like. But our bigger problem is combating free movies on tubes. Why don't the FSC spend more time on combating that. They should have work on combating tube a long time ago.

Actually FSC is in the forefront of combating piracy on tubesites and has been successful with our industry-wide program, APAP (Anti-piracy Action Program). FSC applies a stick and carrot approach to tubesites. Companies can choose one or both of these approaches for their business.

Enforcement-Track and Take Down Content and Litigation
First, the stick?TRACKING AND ENFORCEMENT In this approach APAP participants are given a copyright analysis of their content by Attorney Gill Sperlein who also assists the content providers in developing a plan for making sure their content is properly copyrighted. Businesses participating in the tracker component of APAP have their content tracked every two hours on 16 selected tubesites with state-of-the-art technology. Tubesites are selected by their Alexa rating (highest -trafficked sites) and through participant input.

APAP technology gathers information and develops an evidence packet of materials for each infringement. This information saves a great deal of attorney time and expense for those companies who choose to litigate and FSC can help coordinate litigation amongst participants. Once infringements are found, DMCA takedown notices are sent out and tracked every two hours to determine time and level of compliance. The tracking technology utilized in the enforcement phase (Vobile?s Videotracker software) incorporates audio/video fingerprinting and meta-data. This state-of-the-art software offers the most comprehensive and effective technology available to track, take down and document infringements of your content. There are costs associated with the enforcement phase of the program but content providers can participate in the enforcement phase for as little as $400/month.


Monetization-Tubesite Affiliate Program
Through a coordinated effort in APAP?s Tracking and Enforcement phase, participants pressure tubesites to adopt Mediawise--the carrot. Mediawise technology uses audio-video-metadata fingerprints to STOP content from being uploaded. Instead of pirated content going up, the software applies the business rule the content provider wants for that title and either truncates the content or provides a trailer, both with an overlay ad that takes the viewer to the content provider?s site. Content providers fingerprint their entire library and their content only goes up in the format the content provider wants it to. With this approach, the content provider not only blocks stolen content from being uploaded, but also realizes a potential new revenue stream.

This program is free - There are NO costs for fingerprinting and no upfront costs, content providers only pay if a purchase is made

FSC acts as an affiliate for content providers. Once traffic from a tubesite converts, the content provider pays FSC a percentage of the purchase (in order to track purchases, content providers give FSC an affiliate code) and FSC pays the host tubesite and Vobile.

If the content provider is participating in the Tracking and Enforcement phase the content provider keeps 60%*of the purchase. If the content provider is NOT participating in the Tracking and Enforcement phase then the content provider keeps 50%* of the purchase.
