domain problem

I bought a domain name last year which I renewed this year.
I just realised that someone is using my domain.
How is this possible.

I contacted webdomain.com and they said that their payment processor never send them my money so for them it was never renewed. This is bullshit!!! I had a very good domain for sale. usaelections2012.com
They will definitely hear from my lawyer.
