Using an existing dot com domain as a dot tv

There is a main stream site using a dot com domain. Would I have a problem if I used the same domain name with another extension. Could the main stream dot com site shut me down or cause a problem? It is not that I want to do this and usually don't as a rule, but a client is insistant on using it with a .tv extension.

The domain name is a fairly common girls first and last name combination similar to susansmith.com for an example. The dot com site is a dance studio business completely unrelated to adult.

If the name is free, you're allowed to take it. Maybe they won't like it, but they can't do you anything.

youll lose a little traffic to the .com cause people still assume everything is .com if they dont remember the name perfectly. I own StreamMe.tv and StreamMetv.com (lots of people were doing this streammetv.com mistake, moreso than streamme.com) unfortunately I was unable to buy streamme.com, however 20-30 people a day google "streamme.tv" so I think its alright.

Wouldnt worry about legal issues, there isnt one.
