    Getting Started.

    Hey everyone.

I was planning on starting an adult based website, having unique content and models on it. The problem is, I have never started one up before, and I was wondering if anyone can give me any tips and help on it.

What kind of contracts do I need for the models? What are some kinds of things I should look into.

The site will be hardcore, for those who were wondering and can help. I am a designer, so I already got the design aspect part complete... just need help with the actual content part. Thanks everyone.

If you're serious, you really need to contact a lawyer.

You will need to have a good understanding of 2257 regulations and document requirements.

Second, you will need 'model release' forms that include the payment terms or a separate contract as well.

You can get some general information, but you will hear the refrain of 'get a lawyer' a lot to questions along these lines and it's good advice.

    Hope this helps a bit.

yep, getting a lawyer would be a place to start. Apart from that you have A LOT to learn if you want to be successful with an adult website. It's a hard time to be getting into this business.

It never hurts to work with a lawyer, but if you don't want to pay hundreds of dollars an hour for general information there are other ways to get the info you need. I highly recommend talking with someone who produces their own content and knows the ins and outs of the business. I say save your money for a lawyer for when you have specific legal questions or technicalities that you need cleared up. Things like model contracts and 2257 docs are basic things that producers deal with everyday and I'm sure one would be more than willing to advise you on them.

BTW, anyone can read the US govt 2257 statute for themselves to find out exactly what is required.

This can get you locked up as easy as not having it at all.

Talk with an attorney. there are some that frequent this board as well as other boards,

Some will help you out for very little for the docs you need.

How so?? 2257 is written out in plain English. There's a basic set of things you need to do to comply with it, and anyone who deals with 2257 on a daily basis should be able to tell you what those things are; This goes especially for those producers that have their shit together and/or have already spoken with a knowledgeable attorney. It's a bit ignorant to assume that just because someone didn't go "directly" through an attorney to get their 2257 info/docs that they will get inaccurate information, or not know what they're doing and be on the road to getting themselves locked up.

You can contact me by email telmo [at] 4pleasure [dot] be. all documents are in English. they were reviewed and aproved by our attorney ( belgian company ) but it's probably a good idea to have them reviewed by one in your country too.

It never ceases to amaze me how many people think they can produce porn totally without legal counsel. Sure, you can copy someones model release and contracts..... but do they apply to the laws in your county, state, and city? Sure you can read 18 USC section 2257 but are you familiar with all the current case law? Sure you can stand there and tell some disgruntled model's attorney that she doesn't have a leg to stand on while her wealthy daddy is prepared to spend thousands to prove you don't.

Never, never, never implement adult contracts that have not been thoroughly reviewed by legal counsel . Something as simple as the location the porn was produced can land you in jail or at a minimum, make all your contracts null and void.

Sure, you can and should do the leg work, copy the best parts of others releases and contracts (with their permission), read as many of the applicable laws and regulations as you can get your hands on, get a basic understanding of contract, copyright, trademark, cooperate, employment, general liability and other areas of the law that will apply. Only a fool would waste their time and money producing adult content without at least running all your contracts, releases and record keeping system past an attorney BEFORE producing the content.

Whats a few hundred bucks up front compared to loosing the ability to use your content - or worse yet, loosing a liable suit because you didn't cross all the t's and dot all the i's.

If you are in the US get a lawyer ... if not, read up on the porn laws of your country, put together 2257 documentation (so you can sell to the US) and get producing.
