    Another 2257 question!

    I'm still tryin to get this straight so I can get back to building galleries. Most of the notices I get from my sponsors use the word "depiction of explicit sex". Does that mean you can suggest explicit sex with nude men and women in the same scene but no contact with any genitals by hands, lips, toys or anything? Do these retards consider breasts genitals? Are any hands allowed on them? Can a woman show pink without any contact with the genitals? Can you show a woman who recieved a load somewhere on her body when there is no genital contact in the photo? Can a nude man and woman be kissing? Can you show someones dick 2 inches from a womans mouth as long as there is no actual contact?

    You get my point! Or is the general rule simply this - You may show fully nude women as long as the legs aren't spread and nothing in the scene even suggests sex of any kind?

    Also, many hardcore galleries provided by sponsors have a 2257 compliance statement at the bottom of their galleries. If I use their supplied hard content to make my own galleries, can I copy the link from their gallery and put it on my own since the content is from the same source, or am I required to have physical or electronic records of the models involved and not just the custodian of records?

    Man this is such crap. If someone could clear these things up for me or point me to a place that spells all this out, that would be great.

    There is a million ways to interpret the above definition of "sexually explicit".

    The benefit of having your lawyer explain the definition to you, is that he/she will be at your trial. No one here will be there for you, and so YOU must come to your own conclusion that YOU will be able to live with *if* shit does hit the fan.

    The rest of this reply is assuming you aren't capable of consulting an attourney.

    The best way for you to truly be comfortable making this decision is to search the forums, read threads, read the laws, LEARN and try to UNDERSTAND what these laws mean. You have to be your own lawyer. Don't be a fool and blindly follow what somebody on some board says you should do/is okay to do. Also, do NOT take legal advice from a sponsor. Regardless of what their "action plan" is, it does not apply to your situation as a reseller. Their lawyers are consulting to them to cover THEIR asses, I doubt they have your best interest in mind.

    If you want to be 100% safe, only use non-nude content.

    If you want to take a chance, then draw your own conclusions.. have some girl inches away from a hard cock... Do you think you or anyone defending you could convince a court judge that its not sexually explicit as long as the model isn't touching the genitals?

    Yes, if you want to host and distribute sexually explicit material, then YOU must physically have the model release and photo ID. This is what the whole fuss is about. Do you think if you could just link to the sponsors 2257 page, everyone would be so upset?

      Thanks For The Comprehensive advice.

      It's much as I thought. When I go to court (and it's been 14 times now because of my EVIL & Stupid X-wife) I set the case. I find that lawyers, especially ones that don't get instantly rich off the case, rarely do what it takes to put together a good one. Aside from the technical stuff, I design it.

      The best advice I could give is to never go there in the first place. It's insane. Nothing real goes on there.

      I think I'll be going with hosted galleries for a while and play it safe until I hear what's goin on.

        Theres a certain adult webmaster board that hired an attorney to specifically answer 2257 questions.

          Is the 2257 something that is enforceable? Anyone plan on not adhering to the law? What would be a consequence of this?
