Domain deletion process

So Im interested in xyz.com and the status is "Pending Delete", from what ive read it 5 days till its deleted from when it was last updated. Without backordering what is the best way to get the domain?
Some domains ive seen are allready taken when they are still pending delete according to the whois, are they from backorders?
Also when i do a whois it says: Successful domain registrations and modifications may not be in the WHOIS database for up to 48 hours, so how do i find out if its actually taken or not, when i goto a registrar and type in i want xyz.com does it do a whois to check if its available or use another method?

You must try backordering it, if you have luck you will get the domain but its very hard.
