    is this illegal?

    My girlfriend called the landlord of these apartments we were interested in moving in to.. everything is going well and then my girl said

    "It will be my boyfriend and I living there"

    And the landlord said that will not work, you can only live alone there. She said excuse me, and the landlord told her that it would have to be just her.

    Is that illegal? Saying that your boyfriend/husband can't live with you? They have other crazy rules too

    no kids
    no pets
    no smoking in your apartment

        You cannot say no kids, I do think that is against the law.

        The no pets thing sucks, but they can get away with that.

        Not sure about the other. Why would you want to move into a place like that anyway? The guy sounds like a real asshole.

            actually, that doesn't necessarily hold true.
            in most places, the rental boards sets out conditions that landlords must follow. and they cannot discriminate.

            for example, in montreal, everything he said the landlord is doing is illegal. you can't forbid kids, spouses, smoking or pets any more than you can forbid asians or lesbians etc.

            the problem is, there's very little you can do about it. you're not entitled to the appartment and he can very well rent it out to someone who fits his "rules". and unless you can prove that he goes by these "rules", you're up shit creek without a paddle.

              What if I had a child, how can you tell me I can not have the apartment because I have a child?

              if I smoke, and I pay the rent, I expect to be able to smoke in my apartment

              Why would you have to live alone? What if we were married, that's discriminating

                  It is to illeagal. I am a landlord (thanks to porn ) and the only reason he can deny you is a)one of you have bad credit or low income b)evictions or c) he's rented it out . Have him give you the reason for your denial in writing. If he's stupid enough to then sue him. As for kids... thats a real big no no . States generally come down very hard on that.. no pets is legal..no smoking ... not sure about that , but fuck him, whats he gonna do after you already move in? deal with the 3 months it takes to evict someone.... however if you were not on the application your girlfriend turned in he can deny you living there as you were not on the original lease.

                          if she signs a paper where she states that she won't rent it to you because of whatever reason, that should be proof.

                          however, i'm not a lawyer and you should ask one first.

                              That depends upon where you are and state laws.

                              In some states it is completely legal...the idea is that if someone speaks to you about something they are in essence giving you the right to do with that information how you see fit.

                              It's not like they didn't want you to know about it.

                              However, if you were to ask a 3rd party or a 3rd party decided to do so (barring law enforcement who has a proper warrant) to record the conversation that's an entirely different situation.

                              Now regarding discrimination when renting to you.

                              Local apartment boards they can't really do shit. You need to go to HUD.

                                Have your girlfriend call on three-way generally more then two people involved in a conversation under the lay removes the expectation of privacy and invalidates wiretap laws. But Id check with your lawyer first ;)

                                            In some states, it is still against the law for 2 "Unmarried" people to live together. If you find an "Old Timer" apartment manager/owner, they may think "Living In Sin" is a bad thing.

                                              I don't think a "mom and pop"-type landlord should have to rent an apartment to someone he doesn't want to rent to under any circumstance. Large apartments run by management agencies I'd subject to a higher legal standard.

                                                  where do you live? most states in the US have some sort of tenant's right's association. i would contact them and find out what your rights are.

                                                  i do know the no kids thing is against the law. if i were gonna "take em down" i'd get that no children policy in writing.

                                                  i would also write a letter of complaint to the housing authority in the town where you live and make sure to send a cc to the apt. complex and to a state representative or city counselor.

                                                    I lived in many many apts, condos, houses, renting and all those rules are just rules , it is not ludacris at all its just rules .

                                                    If u bought a place like in a condo apt building there is even more insane strata rules if u think that is nuts .
                                                    No kids simply means and Adult building no distubance of any kind. No Pets for soooo many reasons , the damage the noise ect...
                                                    Smoking is same thing as well , these rules are completely legit i don't see what the big deal is ? Just go look for another place and for issue of your girl stating that u will be living with her , thats stupid i agree but there are reasonings for that especially if the building includes any sort of utilites in your rent as well as many factors like more wear and tear ect... . Welcome to the World of Renting ...
