state tax question.. avoiding it

lets say you want to avoid state income taxes in for example cali, and you are a renter in your state, cant you just open a mailbox in say Florida, get some mail there, then go there, get a license, register your car, then go back to california and drive with FL plates..

How can cali prove you are a resident, especially since you have out of state tags/license/ and you work online..

My guess is the rules of "residency" vary by state.

I know for insurance and license purposes, you typically are supposed to reside in whatever state you claim residency for a minimum of six months annually. But that's not to say every state uses that same measuring stick.

I would say you have to talk to a lawyer, and CPA, to be sure what is and is not required.

yeah but if you are renting, how can they tell you were in Cali? you could easily say u spent 11months of that year in florida...

They cant prove if/if not you spent 6months in cali..

oh.. well currently i have a florida address/info, so you are saying if you go and visit and stay with your mom in new york for a year, then you gotta pay state income taxes to new york for that year? assuming you are originally from FL

If you're in Cali I would suggest getting a Nevada license. A little more realistic to your situation.

Driving around LA with a car registered in Vegas isnt going to get a second look. However just getting a mail box isnt going to cover it, has to be a physical address.

I would consult a tax attorney and I'm sure they can cover all your bases and go over the pros and cons and then you can determine if the hassle is worth it.

They are the worst and it used to be (and may still be) that the FTB was exempt from this clause in Section 3294 of the civil code -

In an action for the breach of an obligation not arising from contract, where it is proven by clear and convincing evidence that the defendant has been guilty of oppression, fraud, or malice, the plaintiff, in addition to the actual damages, may recover damages for the sake of example and by way of punishing the defendant.

Which meant they pretty much had a get out of jail free card to fuck with you.

hehe.. well not legal advice, just pointing out that IT IS possible to avoid it.. i dont wanna talk to a lawyer about it man.. i like keeping my ass out of jail so i pay all taxes due... just stating the obvious, that if you are smart you can completely escape some taxes..lol

also been having a rough patch, cpa networks cut out all those good biz opp/acai offers, so lately havent been doing so great.. making more like $2k/day or so after costs...

looking for the next big thing.
