    DMCA & RSS Feeds

    Anyone ever had someone, or a company, contact them in regards to an RSS feed?

    I had some Pakistan bitch ass trick contact me from 646.344.0021. He left me a message, blah blah blah lawyers, removed from Google, wants the profiteering, etc. and so on.

    He claims I had a feed on some blog that is his, but does not identify his site, or the feed. However, I am apparently supposed to use telepathy to read his mind and remove it bby his insistence, oh "and the paperwork will be coming from his lawyer".

    Since I have no idea what he is talking about, and I have nothing to hide since I bought the blog(s) from DP last year some time, I call the dude back. I wanted to find out what the fuck he is talking about, more importantly, find out feed he is even referring to so I can isolate the problem and remove it.

    From the time the jack ass answers the phone he is interrupting me as I am trying to ask him what he is taking about, as well that the blog came with the RSS feeds, and I need to know more details. He, of course, is more interested in threatening me with lawyers, and paperwork, and how he has reported me every where and blah blah blah.

    He finally has to catch his breath, and I say, "Can I speak now? I bought the blog from DP, I have no f'g idea what you are talking about... "

    Hilarious. For all his threats, nothing will come of it. In the end, he can have the 50 cents that blog has generated in Adsense. He will, eventually, have to identify what RSS he is even talking about, so I COULD actually remove it. So I look forward to those papers.

    As for Google, and all the rest. That is as simple as me faxing forms to Google for re-inclusion, and then counter DMCA. As he did not follow DMCA in telling me what is actually offending, so I could actually remove it in the first place.

    Silly people. If you wanna be big man on the internet, that's fine. But fucking know what you are talking about before your sabre rattling. Normally in this situation, if they IDENTIFY whatever it is in their initial email, I simply remove it and end of story. I forego the whole e-penis, macho man, let's see who has the most money and lawyers fandango.

    I did a reverse look up and see the Paki bitch is associated with some online media companies, none of which I can see on this subject matter. But whatever.

    Anyone else have this happen to them?

                    All in all I am a fair guy, and I figured if I called them back and found out what they were referring to, I can remove it, and then I do not have to worry about more phone calls and bullshit. Especially since I know the outcome of this whole dance.

                    However, as I said above, he was more interested in a yelling match and threats then actually resolving his issue. So at least if he sends paperwork, I know what he is talking about. For all the threatening me with registrar, host, and so on... in the end he, his company, his lawyer, have to tell me WHAT is the offending material.

                    I honestly have no clue about RSS feeds. I know what they are. I know they go with a feedburner and so on. But I bought some auto updating blogs off DP last year, and they basically run themselves via CRON.

                    Which was part of the reason I called, to find out more. But he is obviously a ridiculous little man. So I will wait, with bells on, for my phantom papers so I can remove whatever he is talking about, and then fax in my counter DMCA, and re-inclusion.

                      you could be infringing because rss feeds are not free to republish necessarily, most sites have a tos that goes along with their feed

                      they should have at least told you the site that you are infringing on though

                          I have no clue about it but I wonder if DMCA would even apply here? because it is not user uploaded content, but specific content that you as a webmaster has chosen to publish, making you responsible to follow TOS on that content.... I am not sure what could come of this legally, and whether the onus is on them to ask you to comply first, or if they could go directly to a lawsuit?

                            Well, from his first voice mail, and then screaming like a little girl on the phone and being an interrupting rude fuck, he was citing DMCA in between all the threats, and what he was going to do to me, and so forth.

                            But as I said earlier, in a DMCA, he actually has to tell me WHAT is offending in the first place, and ask me to remove it. Which he has not done. He had two chances so far, and has yet to identify it. So hopefully, if there are actually lawyers, and papers, I will see what he is talking about.

                                He did not identify himself, his company, his website. Just left me a VM with threats and what he was going to do to me.

                                Then I called him back. I asked with whom I was speaking (immediately when he answered), and what company and website he is referring to. He replied, "Is this the owner of that media company". I said, I am the guy you are threatening. Then he went off for like 5 minutes.

                                Every time I would try and say something, he would interrupt me or try screaming over me. Both of which are VERY professional. My best guess is it is just some Paki piss ant who has his panties in a bunch. But he is free to follow through on the threats.

                                But he might wanna follow the law first before getting carried away with all the things he is going to do me in the dark, alone, bent over, and with lube.

                                          I have no problem, nor am I scared of a DMCA. I have been on both sides of this issue over 11 years, and am very aware of what is needed, and how to get reincluded in an index, and so forth. But at least with the DMCA, I would know what the fuck he is talking about. I could then could have removed it, and countered the DMCA. All of which would have taken an hour max..
