    Theft question?????

    How does this site, which has been around for years, stay up and operating. Most of the images are all scanned from major gay publications like Men and Freshmen? And those that aren't look lifted from other paysites (that probably paid for the lisc. ect) Why don't the publishers of those magazines shut the place down?

        Because I don't think the publishers of those mag lisc. their content. They have their own websites, too -- so it would be going up on their sites after it's appeared in their mags.

              The magazines do not care so why are you worried?

              But if they did that with my images, I would have them down in hours. I do care.

                  because it's unfair competition. really tired of people taking the stance that just because the content producer isn't aware of the infringement that it's ok to rip off content.

                  i invest $75,000 in a movie site, and i'm buying content constantly, i can only afford to pay out webmasters $25 per signup or 50% revshare. The cockholster who steals the same content I paid for is paying $35 per signup and 70% revshare. He can do it because he has very little operating cost.

                      Unless I missed something, that's now very old news that was settled. One of the upshots being AdultCheck now very much care about stolen content. If there's proof any content is stolen on the AC system simply try letting them know. After the shit they got in with perfect10 I doubt it will be up long once they do know.

                        that was the point of posting the article. I wasn't taking a shot at
                        AC, it could have been anybody, it's how the judge in that case interpreted what an AVS is and what its liability is where copyright infringement is concerned that is the big news out of that legal battle. Also she apparently bought the 'unfair competition' part of Perfect 10's case.

                        Also interesting in that case is that unlike certain other AVS's with much worse copyright infringement reputations AC does not go the extra step and host that content for 'free' in exchange for participating in the AVS program.

                        That injunction was granted in April of last year. Does anybody know if it's still winding its way through the legal system or it was settled out of court?

                          I haven't investigated AVSs in a while, -- but I doubt much has changed from a couple of years ago. Namely, if they were to shut down all their "participating" sites serving stolen content, they'd be out of business within a week.
