but bear in mind that if you just insert a link titled "18 U.S.C. 2257 Record-Keeping Requirements Compliance Statement" that leads to a page saying you have 2257 records in your office - you are NOT breaking any Canadian laws (because you are not publishing any personal details of the models), but if you actually HAVE the records in your office and submit it in inspection you ARE. - thats my opinon.

if you are a US citizen - you have to comply to 2257 no matter what.

Absolutely. when you deal with images or videos of adult nature - regardless of where in the world you live, you always want to make sure you have the proof that all persons depicted were over the age of 18 (or whatever the legal age of consent is where you live) when photographed. A Canadian Company with servers in the US would NEVER ask you to comply, as they are a Canadian company, and they are still not held to American Laws even if their servers are in the states....keyword being "local" - not US laws. FBI will have no authority over you if you live in a country other than US. The disadvantage of hosting in the US if you're a Canadian living in Canada is that your host may require you to comply with their laws. Even if it's a Canadian company with servers in the US.
A Canadian hosting with an American Company hosting in the states is still only held to Canadian laws, and any host worth having will not ask to see 2257 compliance, as the host is not liable for what the server renters put online. While the host holds the right to shut your service off at any time, any host worth having would require obvious illegal activity or a court order.
As a side note, the FBI would have a bitch of a time getting a court order to shut down a US server owned by a Canadian for not complying with US laws.
By bitch of a time, I mean they would never get it. All they could do would be lean on the host, and again any host worth having will have legal counsel that will tell them to do nothing.
But best bet is to still call a lawyer, the 30 minutes on the phone you would need, or even for him to draft a letter to give you peace of mind will be less then 200 bucks.Coming Soon!Comment
