    Does this constitute a copyright violation?

    Some bitch is trying to get on my nuts for posting a screenshot of her store page on which she is obviously using another store's product image.

    Now she's wanting me to remove the screenshot because

    her "website is copyrighted and I have not given you permission to repost a page on your forum."

    Does she have a point? Opinions?

    If you aren't copying the design to your own site then it isn't copyright infringement. There are special exceptions for screenshots and the like. Moreover, her web site is available on the internet so any expectation of privacy is thrown out the window.

        If you put a review or something under it, then it is fair use.

        Otherwise I would think even though she violated someone else, that does not give yet another person to violate her.

            Usually I'm a champion of copyright protection - but this sounds like a situation where she doesn't have much of a case for herself. Usually someone would have to demonstrate to a court judge how the infringement resulted in 'loss of livelihood'. I doubt she can illustrate that here.

            Not to mention the legal cost (and logistics) of her bringing a case against you.

            I ain't a lawyer, though. So don't take that as gospel.

              If she contacts you again tell her that an excerpt for the purpose of review or commentary falls under the fair use law and if she doesn't like it she should work toward having the law changed. .

                  All you have to do is resize the screenshot and hyperlink it and it falls under fair use -- at least thats how it works in the US. This is exactly what Google News does (and yes, some newspapers are pissed.) If she is stealing a pic I would have just contacted the person she stole it from.
