If a domain is set to expire in say 2 weeks and i cannot get a hold of the person hwo owns it. is there anyway to purchase the site, so to say, as it expires, but have it just transfer rather than expire first?

umm... you can backorder the domain - so if and when it does drop it will be picked up for your immediate registration.
