        As in a user signs up for a recurring service only for you to find out they cancelled that option at the bank's end? Wouldnt that just mean you just get a decline?

            Sure a decline on the first rebill attempt.
            I do not think this will effect those using 3rd party processing based in the us. Not YET anyway.

              different banks have different response codes to transactions. This one in particular is apparent that his cc company allows for him/her to signup for something and make the decision with his bank and not the merchant whether or not it recurrs. Similar to virtual cc numbers where you can set the expiration date.

              I don't know if it's new, just the first time Ive seen that response code.

                boils down to virtual cc#'s generated by your cc provider intended for online transactions where you set how far the merchant can go instead of the merchant offering disclosure.

                  not at all, it is not left up to the consumer if it can rebill. They can decide at the POS.

                            the trial goes through, but the retry attempts on the failed recurring are stopped dead. You can set this function in some cc's admin.

                            Its like signing up for a free cell phone with a cc and then telling your cc you dont authorize future billings from the merchant even though you have an (implied) contract.

                                              Simple. In your terms, define a "period" of time, that they are allowed to cancel within, that they must do it manually. If they do not cancel within that amount of time "manually", they are liable for the rebill charge. If it gets declined @ the bank. Dispute it and show them your terms, or simply manually charge them. Maybe invoice them. Whatever, send it to collections, the point is that you should define the "period" of time in which they must cancel manually.
