i talked to a friend of mines friend whos a lawyer for a very large aduld company and he explained to me what areas i can do this in (yeah that totally fucked up my main place that i wanted to shoot) and he was going to send me a model release but the fax didnt go thru and he is hard to get ahold of. do you need a certain release for each city/county? i have about 3 different places i'm going to be shooting so would i need 3 separate releases?

What this guy knows about photography can be written on the back of a postage stamp. In capitals. He's a hosting company or so his banner said yesterday. Only thing is no one at the company had heard of him. Could he have been lying?

They are pretty well standard all you have to do is change the names from mine to yours. You do not need to speak to a lawyer. A good Photography magazine will tell you where to get one.

All the magazines use a pretty standard model release form, the only change it the layout and the company who is recieving the models permission to use the images.

If this guy knows diddly squat about photography may be he can tell me why I ask "Where do you live" and what is important about where the model comes from?

Let me make sure I am understanding your advice. You are telling a guy NOT to consult an attorney before he does something that could very well end up costing him everything he owns if the model later decides to sue him?

Look Charly, (laying my guns down) I am not sure how things are where you live but in the US people love to sue the shit out of each other. Laws vary not only from state to state but also from county to county and city to city. Let me give you some examples:

It is not legal to photograph actual sex acts within the city limits of Las Vegas, NV.

Photographing of topless females is legal in public areas of King County, WA but bottomless photos could land you in jail.

These are just two examples that YOU most likely were not aware of. If beemk had done either of these things and gotten away with them at the time, he could still lose a legal battle from the model later over these very issues. It is best to ALWAYS check with an attorney who knows the local laws before blindly subjecting yourself to the wrath of the US court system.

Our Government is attempting to shut down the US porn industry altogether. Why give them more ammunition to do this by not covering your own ass?

thanks for the advice everyone, i did check with a lawyer a few weeks ago but he never faxed me the model release so i figured i would ask someone on here for one.

So you are not the idiot you try to make out and you do know something about photography. But we were talking about a model release, not the local law. There is no model release that covers you for shooting something illegal where you are. You get a model release from a 17 year old and the shoot is still illegal if it's adult, plus she is too young to sign a legal contract without her parents/guardian to verify it.

I emailed the company on your banner and got back that they did not know who you are. So who are you?

Who said I know jack about photography? I know a lot more about US laws then you do. The release keeps a model from going after the photographer. If the photographer breaks laws when working with the model then it can void the release. Common sense dummy.

Now if it is good enough for these people and they have enough money to make it worth suing them. Then it should be good enough for us.

If a lawyer cannot supply a model release, should you be asking him about the law on photography. It is a common misconception that lawyers know every law.

But Space is right, always check that you are not breaking local laws.

That is my entire point. ALSO the release may need to refer to specific local laws. MOST of the time it is not necessary but there are exceptions to every rule. I would not buy a new car for my business without consulting with my attorneys. Some of us have WAY too much to lose. I did not fight my black ass out of the ghetto and earn what I have just to let some stupid local law take it all away from me.

actually he was going to fax me a model release, so since i dont have a fax i had him fax it to kinkos. i went to get it and either he didnt send it, or they couldnt find it cause the worker was looking through a stack of about 100 papers. and he works in an office and when i call i get his secretary. so instead of playing phone tag i figured it would be easier to ask someone on here.

Take the release that Charly has offered you, call the attorney and read it to them, and ask if it is acceptable. IF you can not get through to the attorney then WTF are you using him for anyway?

I offered the truce a couple of replies up. If you would read replies before running your fingers (mouth) then you would be better off.
