    Content Liability

    Hi all,

    looking for some clarity on a legal area, which may be obvious to pros, but is not to a newbie like me.

    Tube sites simply pull content from the large porn providers like XVideos, Xhamster etc, and this content is then displayed on a wp site in a tube format, or some other method but still its content pulled from the large providers.

    My question is, have any of you guys and gals out there that are experienced with this had any repercussions from copyright holders of the porn? for instance DMCA takedown notices, legal letters, or more?

    I am interested as I am exploring the best ways of getting started in this industry and wanted to check out the basics before dipping my toes in. This is something that I could not find a clear answer on .

    I use to run a tube site, pregnant porn, it was very hard to find affiliate program to pull videos from so I had to get them other ways, in the 2 years I had the site before I sold it I was only emailed 3 times for a DMCA takedown notice, I took the videos down and never had anymore issues, what I ended up doing was link the site or models website and this took care of any future DMCA issue

        We provide a legit content to xHmaster, xVideos and the like. We also have a business affairs department which sends dozens of DMCA notices weekly to tubes including those I provide content to. Funny no ? But true... The rule of thumb is :

        If the video is shorter then 10 min. and has a watermark of the original producer NOBODY will bother you, because it is probably legit or to short for the copyright holders to bother...On the other hand:

        If the video is over 10 minutes (or to be more judicious 15 minutes ) or it has NO watermark it is likely pirated and you will get hassles from producers and rightly so...We have succeeded now 2 x for the host to dump a tube site which did not respond to our DMCAs.

        The issue here is that starting with the likes of Youtube down to the smallest tubes, there should be a "running time filter", blocking long uploads (or at least moderating them). This would save a lot of hassles to both sides.

        You should set up such a filter and will never get any hassles..

          @ celandina thank you for the info, clearly its a problem for all sides. I totally appreciate the annoyance of creating content and being ripped off, and hence want to learn the best ways to steer clear while building a small community around good content.

              Our basic rule of thumb has always been simply that if we didn't get permission explicitly, or purchase it ourselves, then it's not ours to use.

              I don't think it can be much clearer, to be perfectly honest.

                We get sent so many videos uploaded to us but any email requests or dmca's & the vid will be pulled instantly

                  Your policy is inherently supporting pirates. It is no different then if you had a warehouse full of stolen goods and had the excuse: " well, if somebody tells us this ( or that ) item is stolen we give it back, in the meanwhile we are selling everything we have, stolen or not"
