    Serious question. Please

    Hey everyone. I have a serious question wondering if anyone has gone through anything similar and if you have advice. A family member is in a child custody battle with an ex. The ex is threatening to use the fact that I produce porn in court against him. Even though it is completely detached from them. Meaning I rarely even talk to them or see them to begin with. Yet I don't know how that will play out in the family members custody battle. Does my career choice have any impact on their lives and does that belong in court? Should the judge rule against my family member because someone in their family that doesn't even live near them produces porn? If so wouldn't that be infringing on freedoms of speech and discrimination?

    I ask here because I am not involved in this case. This was brought up today. My family member already has a lawyer and I don't see the need to get my own right now. If I have to I'll fight back big time but just wondering if anyone had any similar experiences.

      Write a nice letter to the ex telling her your not involved in porn and you would not be happy suing her for defamation of character.

        Unless you are residing in one of the radical Christian counties, your choice of career, should not impact the outcome of the custody hearing/trial. All the other side can do, is attempt to shame/embarrass a few people, imply that you have a closer relationship (ie. living with the family member, babysitting the child frequently) and make allegations, __________, would negatively influence/bring harm if they raised the child in question.

          I will tell you from first hand experience.

          It matters nothing. You are not even the spouse in the divorce. But as long as the kid is not involved, it doesn't matter. The way the law is written is they ask the question, "does this negatively affect the kid"... if the answer is *no*, the ruling is it is irrelevant.

          BTW... I bet your family member and ex never go before a judge unless one of them have some money and a die hard determination to rule out common sense, rational, and decency. Almost all cases are resolved in some form of mediation.

              I had a girl that worked for me (state of California) go to court on a similar matter. The judge deemed that she had a job which was fully legal and as long as she didn't take the kid to work it didn't matter. If she would have been a hooker as her husband implied than that would have killed her case and she would have lost being that it isn't legal work in our state. The funny thing was they ended up increasing the child support she got from her husband because of the fact that she had to resort to working in porn because her husband left her destitute. The whole porn thing totally backfired and blew up in her ex-husbands face.

                Consult with a lawyer right the fuck now and waste no time doing it. When you get a dicklick like the one you are describing on the prowl the possible ramifications cannot even be imagined.

                      Guys, thank you for the advice.

                      I have to update and say he lost and only has visitation rights UNDER SUPERVISION. She used us as an example to build a case that our family is crazy. And he also works on the days supervision is available which means he doesn't get a chance to see the child at all. Horrible.....especially today when we all realize just how precious our children are.....

                        That was fast... you just started the thread yesterday. My ex filed a PFA against me and caused all kinds of problems which were thrown out of court... eventually. So your family member is the wife and she got sole custody of the kid in 1 day? Sounds like a PFA was filed.

                        Oh well... it will all work out.
