Now, what if something needs to be reviewed by law enforcement? Can't a video archive of that session be subpoenaed from the Skype servers, if a dispute arises with regards to extreme cases, such as those mentioned in your examples, where there needs to be a review?

I'm not convinced that every girl performing independent Skype shows without a recording of it, other than on Skype itself, which I am certain they have, is in violation of any law.
We don't "record" any users content, nor do we download an entire websites catalogue. We just need a way to view the content to verify that it conforms to Visa/MC standards. Most of our webmasters only receive a "spot check". Meaning we only test one or two videos at max. We have a risk management team that performs these checks. If Visa/MC were to find scat videos, we would be fined. Not the webmaster, but us as the processor. You are correct we have no way of verifying content on Skype or even webcams, but we do ask the webmaster to keep a log of such transactions. This is so we can at the very least, verify that the call or cam session took place.

3D Secure can be tricky with adult. Adult transactions are "typically" an impulse buy. Kind of like grabbing a candy bar on your way out of the supermarket. Adding in 3D Secure to an adult website requires your end-users to grab a cell phone and wait for an SMS code or they have to punch in a pin to complete the transaction. In a lot of cases this could cost more sales. This is why we partner with a company called Iovation: www.iovation.com. These guys keep track of fraud from not only adult, but also other types of ecommerce. So if someone is guilty in the past of what we refer to as "friendly fraud", we can generally identify them before the transaction takes place and can prevent the user from purchasing from one of our webmasters. Iovation has helped us tremendously in terms of fraud and chargebacks.
