So a user of the site can't really claim they were mislead, because they agreed to this TOS when signing up (and people DO upload these themselves, so it's not nessesarily Match.com doing it), and they would be protected by DMCA/EUCD for users uploading copyrighted images. I am confused as to what exactly are your lawyers intending to argue?
I could see them argueing paris hilton images or something, but with all respect melissa midwest is not a super famous entity. I have worked in porn for years and i wouldn't recognize her...
