Actually there is no such thing as a "loophole" in American law. Everything is perfectly legal EXCEPT, what is specifically illegal by constitutional, federal, state or local law.
If a copyright or patent law says you have X number of years to claim or there are exceptions such as fair use, or other reasons. These are not "loopholes" if you use them after the X years or other fair use.
Idea of "loopholes" came from politicians who tried to be more hard criminals than the other guy. The Miranda ruling gave politicians an excuse to blame the Supreme Court for letting criminals off on "loopholes."
Those "loopholes" are our basic rights.
