Well, it's deceptive to market a model with pictures which are not current. Nonetheless, it's your responsibility to check things, ask questions and do some due dilligence. Not being happy afterwards is not reason enough to not pay. I would ask the photog if he thinks it's fair with a discount or a new shoot with another model. But not pay because you forgot to ask the necessary questions, as much as one would want business to be fun, friendly and fair, it's not and this is why you have to ask questions first.

Try to negotiate a deal, but to not pay, that would be even more unethical than what the photog did. A discount from the photog would be fair though.
