dumbass cop

I was leaving blockbuster yesterday after renting a couple movies, and i get rear-ended by a stupid ass cop in a suburban while waiting at a light to make a left turn. I don't know how he could have not seen me, but he nailed me going about 30-35 mph, and pushed my truck about 15 feet.

First time ive been in an accident, hopefully the last!!
Most of the impact was made on the tow/hitch, took my rear bumper off shattered my rear windows and did some body damage. The guy at the storage lot said that it was a good thing i had a hitch otherwise there would have been a lot more damage. The suburban was real smashed up. I was amazed that my suv didn't have more damage done to it when i was comparing it to the suburban.

My neck and back was hurting so they told me it would be best to go to the hospital, and when i was getting put on the ambulence, i heard the cop say "I don't know how i missed you, sorrrrrrrrrrrrryyyyyyyyy!" while he was getting on another ambulence. My x-rays came out fine and was released a little while later but now im just sore!

what a way to spend a friday

he was on duty bone, more than half the cops here are either in expeditions or suburbans.

In MD, the State has Immunity to civil suits (as all states have the right to), but allows itself to be sued up to $50,000. There was a case where a state cop hit a car and killed the woman (I think it was a woman). Her spouse sued and won more than $50,000 (They don't tell the Jury about the limit) and they went after their own insurance for the extra amount - because they had uninsured motorist insurance. The insurance company tried to get out of paying the extra - saying the 50k immunity level should protect them too.

They lost - it made my day....

Anyway - if you get hit by a cop make sure it is a county cop. They do not have immunity. Same if you get beaten. I had some state emplyees that I sued (not for beating me) and it was a real pain in the ass. I won in state court after appeals on non monetary matters, but when I got to federal court - it eventually got thrown out, because they had immunity - and I had not met a big enough burden to overturn it.

Depending on your state - you can really get screwed. Getting hit by a cop is not an instant payday - especially if they are state cops.

So if you decide to mouth off to a cop - and there are two different ones standing their - pick the county/city one.

Just my advice for the day.

Isn't that stupid? If the woman had been hit by a county cop instead of a state cop - there would have been only the normal limit - which I think is like ~$325K in MD.

The thing is, i'm not planning on a lawsuit at all, I seem to be fine, just a little sore. As long as their insurance fixes up or gets me a new Denali, I'll be happy. I don't really have any grounds for a lawsuit. No one died, no serious injuries, just a fucked up car, which im sure their insurance will take care of

Accidents suck. Well hope everything works out ok. At least he admitted to it (which I guess is pretty hard not to if your rear bumper & hitch is sitting on his front grill). My mother got really screwed over in her accident - was messed up for like two years - and those insurance company bastards were trying to blame everything on some of her other medical problems.

They will still pay you for pain and suffering if you were sore and had xrays. Unless you have some moral objection to taking some extra money. It won't be much, but you could invest it into your business.

Ah, I see you provide legal consulting - so you probably already know this.

Having been rear-ended (LOL!) myself and knowing of others that have had accidents like that, if you're sore, you're probably going to have more pain within a week or two. Keep EVERYTHING documented, and go to a doctor that's approved by your insurance company, for any pain you feel. While I'm not saying "sue," you should be compensated for all expenses, including the hassle of being hurt. They don't call it "pain and suffering" for nothing.

everyone is lawsuit happy for the main reason that its almost the only way to get anywhere now-a-days. Think about it, you get rich and what happens....SOMEBODY SUES YOU, plus in this situation I would try to FUCK the poice dept out of everything I could, those sorry fuckers would do the same to you even if they just caught you smokin a joint.

At the time of the accident, before i was taken away, the cop that was doing the report or investigating the accident said to just call the dept. for my report and handed me his card. I bet they are going to try to switch things around and blame ME for it.
