we have a potential customer for a bunch of hardcore 8x10 prints ($600+)
who wants to pay via cashier's check and a faxed copy of his driver's license since he does not have credit cards.
he swears he's 24

is this even worth a call to the attorney?
or should i just say no thanks?
or, fuck it, it's a $600 sale?

Not a lawyer here although I studied law, but you probably only have a reasonable duty to check age. If someone from out of state can provide a valid drivers license, has access to a fax and a bank check, you've probably done your duty.

Most people selling porn dvds take checks through the mail if you certify you are 21.

How are you verifing age now? You can be 16 or older to have a credit card, so you can't use a credit card for age verification.

I hate to break the news to you, but 5th graders are getting cards these days. The limit is always low, like a couple hundred and it's of course co-signed by the parent. But they can get them.

Credit Unions are the ones issuing these credit cards.

I don't know how young typical banks go on their debit cards (likely 16). And there's also the issue of gift cards that can be used anywhere Visa and MC is accepted.

we have our own merchant account for processing cc's with adult level scrubbing software which covers us against issues such as these
