Law

Hey,

Can someone help me find regulation/law information regarding hosting adult sites on a server in:
  • Illinois
  • California
I'm looking to start a new site but I want to know that I won't be breaking any laws there. I'm concerned on the 'obscene' aspect. Main examples include:
  • Content showing urination.
  • Use of food objects, penetration, erotic manner
  • Candles, candle wax
Any help appreciated!

You need to talk to an attorney. I wouldn't trust any legal advice you get on a forum where most of its members want nothing more than to see you fail miserably.

I don't even if I am new. I was hoping for links to government sites for example.

You'll probably want to start by researching 18 USC 2257 records keeping compliance. 18 USC 2257 was amended recently with the passing of the Adam Walsh act, and so you'll want to research that as well.

As for obscenity, you'll want to research the Supreme Court's ruling in Miller v. California, 413 U.S. 15 (1973).

However, I am not a lawyer. I'm only providing this information so that you can ask some informed questions to an adult industry lawyer.

If you read Miller, you'll find that "obscenity" is a judgment call based on the standards found in the local community. Thus, in theory, something deemed "obscene" in Big Sur, CA, might not be considered "obscene" in LA.

If you're that concerned about it, just host it offshore.
