i see that lot of websites download real home videos and re upload them with a watermark of their site to get more traffic, is that legal?
or is fine cause its already public?
No. If you do not own the content do not pretend you do.
its not pretending you own the content, is just saying you can watch more videos like this on this site...
a friend told me its legal, since it is public content.. but i am not sure since i dont know about internet laws..
Not everything needs to be "copywritten" to be "owned" by somebody.
If you are using somebody's footage and didn't get 2257 forms or original model releases along with permission to redistribute, don't upload it.
my friend told me that a lawyer told him there is a law that states that all existing Internet content becomes public.. i will have to ask a lawyer my self..
but do you think that the owners of all this copyrighted videos are uploading the videos to xvideos.com tube8.com and all this tubes sites? i dont think so...

Of course the owners of the copyrighted content aren't uploading it themselves. Just because others are doing it doesn't make it legal though. The people who -are- uploading the content are infringing on the copyright, which is illegal. Perhaps you've heard of piracy when it comes to music, movies, games, and software. It's no different with porn.
It's just not a risk that you want to take. Say for example, you upload a video from Brazzers, and stamp your sites URL in the corner of the video. Now they know -exactly- who to file charges against. They'll have more money, and better lawyers than you do. At the very least they'll have enough muscle to get your host to suspend your site for hosting infringing material. That's less likely with the grainy cell phone type videos I assume you are talking about, but it's still not the best thing to do.

No. If you don't own it, don't upload it. You can't prove the models are over 18 (or the legal age where filmed), or that the footage was shot in a jurisdiction that allows such things, etc.

ok, do you know a safe place or content producers where i can buy good content?
As an aside, many people here make a living (or try to) in the adult industry - and many are content producers, or webmasters that buy and then resell that content on their own sites. The reason that you got so many hostile responses to your question is that "free" porn sites perpetuated by content uploaded by those without the right to do so is a major thorn in their sides (to say the least) and marginalizes the for-profit content.
There is certainly a legal component to unauthorized uploads as I mentioned before, but it is the ethical component that is chafing people here the most (I imagine).
Just didn't want you to think that people here were being dicks for no reason.
