    Guy claims $300,00 for $16 court filing via Adverse Possession

    By the looks of it, the guy has more hurdles to jump before he gets the house though. One of the requirements of adverse possession is that you pay all property taxes on the property in addition to public claims of ownership adverse to 'real' owner.

          Adverse possession exists in my part of the world too (Victoria, AU) but I think the required period here is 15 years. It's more to prevent neighbours trying to make you pay market value for a tiny strip of land because they suddenly realise your fence was installed 5 inches too far onto their property 26 years ago.

          You'd have to be a bit of a c**t to pull off adverse possession of an entire property or house, because you're really claiming something that was never rightfully yours...

            A guy in the Tampa area did that to more than 80 homes. He then rented them out. Last I saw on the news he's still collecting rent. Here's a guy knocking down over $75,000 a month on houses he doesn't own.

              It happens here all the time and only takes 5 years of taxes to be paid and maybe a judge to be paid. All could be done for about 15k.

                The neighbors have a "case of the ass" about it because :

                A. they would rather have an abandoned house on the block

                B. they paid out the ass for their homes so it's unfair

                C. they paid $300k to run away from niggas and one moved in for free anyway.

                          Yeah, it's possible but you would need a court decree and that is not so easy to prove the adverse possession exists ...

                          The elements of adverse possession in *this state* are: actual, visible, open, notorious, exclusive, and uninterrupted possession of the property that was hostile to the owner and under cover of a claim of right for a fifteen-year period. Rozmarek v Plamondon, 419 *this state* 287, 295; 351 NW2d 558 (1984). It is possible to gain a prescriptive easement, also, the elements of which are the same except for exclusivity (it's not necessary for the use by the person claiming the easement to have been exclusive). **Community Crier, Inc v Prose, 242 *this state* App 676, 679; 619 NW2d 725 (2000).
                          Proof of cumulative time in possession by successive persons is also possible.

                              not sure about whole houses etc
                              but if your drive way was slightly on someone elses property and i think 7 years goes by then its too late...cant make them move it.

                                Why aren't more people doing this? Also, isn't there a successor in interest for the mortgage company? Usually when a company goes bankrupt a creditor becomes a successor.

                                          depending on the area of the country, you can get houses for REAL cheap.

                                          my friend bought a $150k house for about $40k from the a sheriffs sale but ended up owing another $50k in leans, taxes and other bs. still sitting on the market from last I heard
