If you let someone hit you in the shoulder once a week for 10 weeks, can i file charges against that person on the 5th week?

meaning, after i file charges during the 5th week and lets say by 6th week, we face the jury, im still allowing that person to hit me for 4 more weeks.. during the hearing, and maybe after the hearing/trial. And yes the judge will be informed that im allowing that person to hit me so i can sue him.

Would the judge toss this sort of thing out? tnx

You can file charges in the first week as you could argue that even if allowed the force was to significant for the agreement equating in assult. You could also argue that you created a precedent in allowing he action in first place. Ether way no judge will put up with that kind of nonsense and will find a way to charge you with contempt wasting the courts time.
