According to USPTO, their trademark application fell through and the appeal was abandoned as of January 27, 2014.

They don't have a registered trademark but it is still a common law trademark via which they have established brand and reputation - more than enough for a UDRP to succeed.

This domain is worthless because Mindgeek can take it at any time they choose.

I understand your disposition, however, I disagree. Yes, they may have common law trademark, but the establishment of " XTUBE ", given its comparatively common name (which is speculation of why the trademark application was unsuccessful) as well as its virtual being, as opposed to something unique such as Microsoft, Tonka, Wal-Mart, Cover Girl, and et al; the common law defense would stand futile in a challenge against a registration or application in court.

In addition, without a federal trademark, the registrant (XTUBE) virtually cannot bring an action concerning the trademark in federal court (via the Federal Trade Commission) to have my domain seized. You speak as if Mindgeek can just go around snatching up domains at will. Yes, they have a large stake in the porno industry, but there exists regulations. I'm pretty sure monopolies are illegal.

Maybe true but the domain name is not worth the headache when xtube.com comes after you. It might be all legal and stuff and xtube.com might lose but you are out time and legal fees.

It doesn't need to go to court. They file a UDRP and reference their well known and established name. You will lose and the domain will be seized. And this will all take place outside of any federal courtroom.

Besides, for being new you seem to know a lot about both Mindgeek and Huntingmoon. Maybe you are not so new after all???

I had a dispute over a domain with IBM , was only asking $1,500 for the domain and they would not pay.

Yet the SCUMS filed a UDRP case which cost them about $5,000 , and i lost the domain .

IBM said they were going to buy the domain at $1,500 on our first email exchange , then they changed there mind and offered me $100 . SCUMS

It doesn't need to go to court, these issues are decided using the UDRP process and I am pretty sure Mindgeek would win and you have obviously demonstrated that you have not registered the domain in good faith. In fact you reference search numbers for xtube in your pitch.

Notwithstanding that, you cannot put anything porn related on .IO.
