In the amicus briefs, the San Francisco-based EFF pointed to cases filed by two porn studios — Third World Media and Mick Haig Productions — whose suits share the same tactics by filing mass lawsuits based on single counts of copyright infringement and improperly lumping hundreds of defendants together regardless of where the IP addresses indicate the defendants live.

"Suing hundreds or even thousands of people together en masse, in states in which the vast majority of the accused downloaders appear to have no connection, amounts to a deliberate end-run around their due process rights," said Matt Zimmerman, the EFF's senior staff attorney. "The suits seem designed to ensure that few, if any, defendants will fight back, given the risk of shame from being publicly identified."
this is to try to stop mass bullying...

"Pink Visual President Allison Vivas, was quoted as saying that "when it comes to private sexual fantasies and fetishes, going public is probably not worth the risk that these torrent and peer-to-peer users are taking."

man porn industry people are way to cocky. you could have shut your mouth and just know what you know. now it just gives another reason to hate on the people from the industry.

good job!

nothing like off beat threatening the public already saying the porn industry holds private information that can be used against people in public.

just genius!

Yeah.... that really helps out... especially by an organization not directly involved with any of these cases.

Eric, I'm sorry that your partner, the attorney Evan Stone's end user law suits are a focus of this amicus brief. However, I think it's interesting to point out that only specific law firms were included in these briefs for their methods for filing. Many other law firms who do end-user litigation were not included and it's important for studios to research which law firms they work with, how they handle the process, and the risks.

As far as my comments, as I mentioned in Xbiz, the comments were not made in the context of end-user litigation as we don't even participate in end user litigation. They were made about p2p sites and the fact that end users have a lot of risks when they engage with a p2p site. Similar to the fact that the FBI clearly lists the less obvious risks of p2p sites http://www.fbi.gov/scams-safety/peertopeer including cp, sexual predators, computer hacking, copyright infringement & the monetary consequences, criminal investigations, and yes public access of your private files.

From the FBI: "Because these systems potentially expose your computer and files to millions of other users on the network"

Whether a user is sued or not, dealing with P2P sites to access content for free is risky business on many levels.
