Illinois Laws on Live Web Feeds
 

We have a client wanting to do live web cam feeds with girls.

We spoke to our attorney about this and he stated that the way the law is written on the IL Books would possibly be interpeted under the Criminal Offenses
Criminal Code of 1961
720 ILCS 5/ Sec. 11-19. Pimping and also Sec. 11-20. Obscenity..

The statement from our attornies is that facilitating the viewing of a sexual act between 2 parties by a 3rd party could fall under the pimping laws in Illinois. I am not an attorney and he also (our attorney) said a lot of this is interpitation.

Any one in Illinois have loopholes or case laws that would show that we can as an Illinois company serve and produce this type of content on the web??

Sounds plausible, except that for an act of prostitution to take place, one would generally have to be doing the sexual activity for the enjoyment of someone PRESENT at the act (participant or direct observer). I think it might fairly be argued that viewing something over the Internet is "presence" in an almost metaphorical way.

I was told that the reason why I can legally photograph sex acts here in Oregon and even arrange them to happen is that no one present at the act is the intended end beneficiary of the act.

Thanks. I will take that interpetation back to my attorney. We what to stay as legit as possible since we are just the ISP and Dev company. But since we will be building and maintaining the site for the client, I know that puts us in the role of publisher. Again thanks.
