Question for all of you content people:

In public places like this do you need to get the girls your taking pictures of to hand out an ID and sign a release form?

Vox 01-08-2003 09:06 PM

Sounds good, and some good people vouching for you. You got my contribution.

BrutalMaster 01-08-2003 09:38 PM

Brutal

4sale 01-08-2003 11:33 PM

You do not need models releases since it's consider public nudity.
public flashing, check the local laws pretaining to it with the Louisiana bar accos.

eisbaer 01-09-2003 01:33 AM

Hi,

you got my 50$ some minutes ago. I'm also down there at this time with Vanessa(see the sig). I'll make some photos myself but we're on holidays so the fun is on the first place.

Can anybody tell me if there is something written about this public nudity stuff thing? Some legal writings about it and where I can find it.

So if somebody wants to meet us contact us at webmaster at vanessamontagne dot com.

Have fun,

Eisbaer

4sale 01-09-2003 09:57 AM

Hi Guys
anybody that wants to hook up and tag team some shoots, that could be a sweet deal.

I have 2 Bars that I always hang out at in the French Quarter
Yo Mama's Bar and Grill on Saint Peters Street, and The Dungeon on Toulouse Street. http://www.originaldungeon.com

If you like to hook up, send me an email, and I'll send you my cell phone number [email protected]

And if you like I can get you guys some free VIP passes to The Dungeon, that way you won't have to wait in line, and pay that $10.00 cover charge.

As far as not taking any pics.
Hell I'll never miss this one great free party

I was born and raised in The Big Sleazy, so I know the best spots to get those perfect shoots.

"Just stand under any balcony that's throwing good beads, you'll get about 100 photos and videos in just an hour"

Ok enough photo secrets.

So far I'm at 550.00, just need that last 150.00

Thanks PantyPimp

------------------------------------------------------------------------------------You do not need models releases since it's consider public nudity.
------------------------------------------------------------------------------------
That would not prevent someone from sueing you for using their image for profit without a release. These are not 'public personalities' where you might have some defense. These are private individuals and they have a right to the use of their image. Just as importantlyk, anyone in the background of the shot would also have a case.

I'm not talking about releases in the sense of age verification, I'm talking about a person's right to the rights to their own image. Just being naked or topless in public does not change that right under copyright laws.

Just my :2 cents:

quote from: http://www.webdesk.com/girls-gone-wild/

Judge King said, "An individual, minor or not, that goes down into the French Quarter must be aware of what takes place during Mardi Gras. This is a well-publicized event that I think anyone local, and even those outside Louisiana, would know what to expect. It seems to me that there was consent. It appears that they were consenting to this type of behavior. They were consenting to the video and/or photographs that were taking place. It seems they were pretty willing. Certainly, as relates to a cause of action, they did not expect this to be a private matter. Because when you do it [expose your body] on Bourbon Street or in a club and you know there is an individual with a video, certainly you must expect that this is going to be shown all over the place."

Commenting on the dismissal of the lawsuit Judge King said, "It is a little mind boggling to think that an individual over the age of, let's say 15, who goes on Bourbon Street and certainly sees this, prior to participating in it, doesn't realize that this [videos] will be all over the country at some point, because people from all over the world come to Mardi Gras and go in the French Quarters."

VirtuMike 01-09-2003 04:23 PM

It's in the usage... If you use it in an exploitive way you're gonna get nailed BAD. Arco Media is out $5 million for something similar. It is beyond me how you are offering to sell rights to likeness and publicity of complete strangers to third parties.

And if you don't have bankroll (at least 6 figures) stashed away to defend against this you're doing your customers a disservice (they aren't immune to lawsuit due to your work). Not only that, but if you can't defend a big lawsuit you're going to tear down the whole world for everyone. All this over a couple hundred bucks?

I strongly advise you to consult your company's lawyer before making this purchase. By using this content you are putting yourself at serious risk (see arco case) and it's WAY more risk than return unless you know what you're doing with it. Good luck.

Chimper 01-09-2003 05:03 PM

I will be donating 50 to you as well. Have fun!!

Ludedude 01-09-2003 06:17 PM

------------------------------------------------------------------------------------
There is no question, you can shoot photos and videos of people in the French Quarter, Bourbon Street or any other public place and post them to the Internet or show them on the TV news. As long as it's a public place, they are on public property and you are on public property, no problem. That is well established in law.

You can actually stand on the street, take a photo of someone in their house, and use it on the TV news. That is an editorial use of the image and is perfectly legal. Lots of legal precedent.

The difference here is selling the image. As soon as you introduce commerce into the equation, the editorial defense is gone (at least provided there is not a newsworthy element). The fact is, selling someone's image to a buyer, and that buyer selling it to a customer, on the 'net or a magazine for an ad for perfume, or anything else is simply not legal.

I'm not sure what case the judge in Louisiana was ruling on, but even if it was exactly the situation I just described...that would only apply in Louisiana. So, if you're selling the photo to someone in Louisiana, and they are only going to use it in Louisiana, and it was only viewed by people in Louisiana, they you might have a defense.

And even then, it is reasonable to say that people all over the world are likely to see the photo...but it is not reasonable to say that the person taking the photo is selling it to someone who is going to resell it.

That is a prescription for a very successful lawsuit.

Don't get me wrong, I love Mardi Gras and taking shots of the people there. But I also don't want to see anyone on this board get sued.

It is legal. Happens every day. But yes you can still be sued for civil damages and said damages have to be proven in a court of law.

Hence, you can be sued but that doesen't mean that you broke any laws.

:2 cents:

IMHO it is a safer than a hard hard core webmaster running the risk with being popped with an obsenity charge, especially sites that display hardcore content with no age verification on tgp's etc...

4sale 01-10-2003 08:18 AM

4sale 01-19-2003 10:12 AM

Ok and update.
I have ordered (2) 128 meg smart media cards, and am now waiting on a reply back from the company that makes the belt battery packs...They were not in stock
So this means that I will have more then enough cards to hold more then 1000 pics, and videos.

Thanks for all your donations

playa 01-19-2003 10:43 AM

shit i must of missed this thread,,
can i still donate?

4sale 01-19-2003 11:25 AM

Yea no problem playa
I am using the extra cash to stock up on smart media cards.
I can get about 300 good pics, or 50 videos on a 128 meg smart media card
So the more I can get, The more I can shoot with out having to go back, and upload and then clear the cards for another round.
I rather walk the streets for 12 hours shooting, then having to run back to the apartment to download every 4 hours.

playa 01-19-2003 12:22 PM

nice,, i sent payment
