These are not 'public personalities' where you might have some defense. These are private individuals and they have a right to the use of their image. Just as importantlyk, anyone in the background of the shot would also have a case. I'm not talking about releases in the sense of age verification, I'm talking about a person's right to the rights to their own image. It's in the usage... If you use it in an exploitive way you're gonna get nailed BAD. Arco Media is out $5 million for something similar. It is beyond me how you are offering to sell rights to likeness and publicity of complete strangers to third parties.
And if you don't have bankroll (at least 6 figures) stashed away to defend against this you're doing your customers a disservice (they aren't immune to lawsuit due to your work). Not only that, but if you can't defend a big lawsuit you're going to tear down the whole world for everyone. All this over a couple hundred bucks? I strongly advise you to consult your company's lawyer before making this purchase. By using this content you are putting yourself at serious risk (see arco case) and it's WAY more risk than return unless you know what you're doing with it. Good luck. |

So, if you're selling the photo to someone in Louisiana, and they are only going to use it in Louisiana, and it was only viewed by people in Louisiana, they you might have a defense. And even then, it is reasonable to say that people all over the world are likely to see the photo...but it is not reasonable to say that the person taking the photo is selling it to someone who is going to resell it. That is a prescription for a very successful lawsuit. Don't get me wrong, I love Mardi Gras and taking shots of the people there. But I also don't want to see anyone on this board get sued. Brutal |

Ok and update.
I have ordered (2) 128 meg smart media cards, and am now waiting on a reply back from the company that makes the belt battery packs...They were not in stock So this means that I will have more then enough cards to hold more then 1000 pics, and videos. Thanks for all your donations |

I am using the extra cash to stock up on smart media cards. I can get about 300 good pics, or 50 videos on a 128 meg smart media card So the more I can get, The more I can shoot with out having to go back, and upload and then clear the cards for another round. I rather walk the streets for 12 hours shooting, then having to run back to the apartment to download every 4 hours. |
