MaDalton 07-30-2010 10:32 AM

The wire fraud charges seem kind of odd. I can see the civil suit for sure, the criminal suit I'm kind of confused about. Is there a precedent for this?

Agent 488 07-30-2010 11:02 AM

yeah:

"The legal criteria for wire fraud was established not on money (commissions) being transferred over the wires, but because of transmission of the tracking cookie between states and internationally."

Barefootsies 07-30-2010 11:04 AM

Interesting read.

This has been going back and forth in the media and on boards for years. Looks like the chicken has come home to roost.

Yeh, I saw that, it just seems strange to me.

Brujah 07-30-2010 11:09 AM

Nice!

Between 2006 and June 2007, Shawn Hogan (Digital Point Solutions) earned approximately $15.5 million in commissions from eBay. Hogan was eBay’s number one affiliate.

Between 2006 and June 2007, Dunning (Kessler’s Flying Circus) earned approximately $5.3 million in commissions from eBay. Dunning was eBay’s number two affiliate.

BigDeanEvans 07-30-2010 11:30 AM

In the end they alwaYs get caught. Crime doesn't pay.

pradaboy 07-30-2010 12:00 PM

So a dude makes 15 mill in commission from eBay and eBay doesn't wonder where it's coming from?

Every crime committed over a transmittal system can be wire fraud.

What do you think the internet is?

It would be a decent forum if they would ban the Indians. That region of the world is an entire decade behind us in online skills development.

The clincher for me was when I looked at their website critiquing sub-forum and an Indian posted a header that looked like he went to Archive.org and ripped it from a site dating to 1996 and posted it for review. What followed was a full two pages of his fellow Indians drooling over his POS work.

Like I say, they are a decade behind us.

Nah. Not with that kind of money. If they let them cop a plea deal, I say they get between 3-5 yrs and forfeiture of all assets.

Feds don't cut no sweatheart deals like that unless you're talking about some little old lady that took 50 grand from a bank she worked at. These guys stole 15 mill- they will do hard time.

eBay would have payed that money to other affiliates, so either way they would have payed that money out, so maybe they simply don't cared who gets it :)

SallyRand 08-02-2010 09:16 AM

The bottom line on this matter is that cookie stuffing, although easy and profitable is fraud, puely and simply. Anyone who has hung around the 'net for a while knew this was going to come from one quarter or the next. The DP guys are shit-for-brains! Anyone who had defrauded a company as large as eBay out of that kind of money should have long ago transferred the funds out of the USA and been living in a country without extradition for white-collar crimes by now.

Idiots.

Sally.

it totally destroys trust in their affiliate system and does or did affect future earnings.

CaptainHowdy 08-02-2010 09:37 AM

Emil 08-03-2010 06:50 AM

Just read this in another forum. Why didn't they stop or at least move their asses away offshore?
