Nope!!!!. If it was a miss trial yes, but this isn't the situation here. The state was not able to meet its burden of poof. The "Double Jeopardy" rule prevents a retrial.

i don't even think they can do that , i'm pretty sure if they bring you to trial they can't retry the case on new charges if the charges stemmed from the same incident , only if they were seperate ( but this is coming from a newspaper law degree :Oh crap )

Yup. Totally agree. The Feds don't drop the ball like that. This was a gift from god to John and the whole adult industry. It sounds gay, but this truly was a miracle.
