?If I were RapidShare, after being identified by both the Congressional Anti-Piracy Caucus and the Recording Industry Association of America, as one of the six worst infringing websites in the world, I would not get all that optimistic. Perfect 10 is very confident that we will prevail in the end.?

RapidShare says in the suit, ?Perfect 10 doesn?t adequately protect its copyrights and instead allows infringing copies of its content to metastasize all over the Internet.?

RapidShare claims that Perfect 10 chooses not to employ commercially available technology and software that could deter infringement of its images. Instead the company ?seeks to foster the spread of infringing works that it owns over the Internet in order to entrap and shakedown websites and services where copies of its images may randomly end up.?

In addition, ?Perfect 10 engages in unfair business practices by tactily promoting allegedly unauthorized use of its works online and then seeking to capitalize on that use.?

RapidShare says Perfect 10 deliberately sends notices that don?t comply with the Digital Millennium Copyright Act or that omit material information, which makes it impossible for Internet service providers to identify unauthorized works.

According to the suit, Perfect 10 has damaged its reputation by allowing unauthorized files to remain on RapidShare?s servers for a period of years. In addition, the suit claims Perfect 10 is deliberately withholding information that could allow RapidShare to remove infringing works.

Therefore, the counter-suit calls for an injunction to order Perfect 10 to include the identification of the infringing files and to send takedown notices to RapidShare to the correct department.

RapidShare wants the court to award damages sufficient enough to deter further unfair and unlawful business practices, attorneys fees and a trial by jury. In May, a court denied Perfect 10?s preliminary injunction against RapidShare, saying it has not met its burden of proof of showing it would likely succeed in its copyright infringement claims.

Norm (from perfect10) should win the Gfy man of the decade award. I don't see anyone else here, big or small, except for some gay sponsors, fighting against file sharing. While Hef is too busy playing with his girlfriends, Norm is making a frontal assult against the enemy who threatens to destroy our way of life. His frontal assults fail because no one else joins him in the attack.

I cant understand .... so many people here complain about too much free porn. Look at all the file sharing forums full of free porn. Most of that porn could be removed with some legal threats and occasional legal action, even without a DMCA from the copyright owner. But no, we all just sit around, waiting for someone else to fix the problem of too much free porn. You guys are pathetic.

The laws protect them, that's why. A law designed to protect webmasters in this world of user uploads basically makes way for illegal activity being well, legal, in a way.

His assault failed because of a load of posturing and refusing to tell RapidShare which files he wanted them to delete. He gave them a really obvious technical getout and destroyed his own suit.

He was also arrogant. He refused to detail or provide links/proof to all the claims of infringement. He was quoted as saying he should not have to do it, or something to that effect.

Battles are not won by one-man armies. And wars are rarely won in the first battle. Norm cant defeat file sharing by himself. This is not about legalism or right vs wrong. This is about life and death. Free porn vs pay for porn. porn as a business vs porn as an unprofitable hobby

Here is what I think. Large porn companies should hire trolls whose job is to remove free porn anywhere they can find it. The trolls' salaries can be paid for by the increased sales due to less free porn.

I am a one-man operation. In the past, I used to remove my own content from rapidshare, plus punish the uploader by removing uploads of other content too. Never once, did I notice that my content was removed by someone else. More Vigilantes in the battle against free porn would help a lot. Who can help to organize this?

I like the salaried troll idea in it's basic link-killing and poster-fucking form. It's something that I thought about a while ago and would interest me to do but I couldn't see the porn companies going with it especially while I could offer no guarantee of increased sales off of it.
