Australian customs officers have been given new powers to search incoming travellers' laptops and mobile phones for pornography.

Australian officials now had an unfettered right to examine travellers' electronic devices, marking the beginning of a new era of official investigation into people's private lives.

Customs confirmed the new reference to "pornography" on the Incoming Passenger Cards and the search powers, acknowledging that searches conducted by officers may involve the discovery of "personal or sensitive possessions".

What's about a constitutional privacy? I mean the right for a private life? What if they will reveal/exposure some sensitive private info while they are "inspecting" your electronic devices? What if I have some telephone numbers I don't wanna others to see? What if I have some docs with medical exam results (they can belong to me of to my patients)? What if I have there my private diary, private photos etc?

Fuckin' western liberalism and democracy makes me scared more and more... :disgust

Australia doesn't have a bill of rights or the niceties therein. The constitution reads more as a framework to facilitate settlement / back door for rogering by mother england than anything else.

When it comes to retarded legislation, I'm pretty sure the voting majority is too apathetic, indifferent or ignorant to do anything. Even if they did, most parties just grovel for public approval and follow up with whatever-the-hell-they-want.

Quite different in terms of civil liberties. Like I said, there is nothing like the US Bill of Rights in the Australian Constitution. The government has much broader legislative power as a result.

Prostitution isn't a constitutional matter in Australia, neither are the types of censorship or privacy issues you mention. Australia essentially has fewer 'safeguards' against such legislation owing to the lack of explicit civil liberties etc. That doesn't help when the Government is sees fit to create seemingly fascist legislation for every issue that crops up.

In terms of tangible goods, I believe the law applies more to the distribution side of refused material. If you try to distribute it, you're breaking the law. It goes without saying that customs will confiscate refused material given the chance.

I believe the Government is still trying to set up internet filtering / censorship. The usual tactic is pretend to do nothing, wait for outrage to subside, pass bill on the sly. The implications of such will be extending the ban on refused material to the internet (in addition to a bunch of other 'unacceptable' content).

Naturally it's the Government's duty to deem what and what's not appropriate. Recently:
  • [adult performers with] small breasts - Possibly banned from publication because they incite pedophilia.
  • Female ejaculation - possibly banned for even more dumbfounding reason.

Not sure exactly what's been written into law, but this stuff is on the table every month.

It's definitely getting a bit ridiculous. But that said, everyone is still relaxed as ever outside political circles... I guess that's why so much rubbish passes in parliament. damn I went and lived/worked in Australia twice, once in 2006 for 4 months then again in 2008 for 9 months.

Both times I went with an external HD chock full of porn.
The customs guys didn't even look at it twice when I went thru.

US customs search your files on your notebook too, what's the difference?!?!

You CAN bring porn into Australia as long as it complies with the local laws.
And yes, customs do watch the porn on DVD or your notebook to evaluate it IF they are in doubt.

If the porn is against the local laws, your notebook gets confiscated and you get fined, but you can still enter the country.
