We apologize for this but due to circumstances beyond our control we need you to remove all links to MySuicideGF.com asap. Sadly, our registrar has seized control over MySuicideGF.com and while we are legally in the right, it will take time for our lawyers to sort this out. Since the registrar will not give us any access to the domain we can't even setup scripts to redirect your current links for you. Tomorrow we will launch the site under a new name and domain name and will email you when that's live.

Regards,
AMA Kings

AMAKings may win in the end, I think they have a fair shot, but honestly, it's not worth the trouble. On one hand SG doesn't own the word "Suicide", but then again, if there was not a Suicide Girls there would be no reason to call the site "mysuicidegf".

The only winners here are the lawyers. :2 cents:

Suicide girls think they own the word suicide? But whats even more retarded is that namecheap would suspend the domain without any case decision. WTF!

They wouldn't necessarily need a case decision if it's in their terms :2 cents:

And the law allows it.

We don't know why Name Cheap suspended it for a start.

What if this was the straw that broke the camels back? What if they have had a load of DMCA complaints prior to this and they decided 'Fuck it, that's it'?

TeenCat 04-07-2010 07:12 AM

DMCA is a law, they can't say Fuck it. Thats like telling "Fuck it, I will just kill the next guy I meet." No matter how bad it may seem, if they remove content within 24 hours, there is nothing namecheap can make about it, they aren't over the law.

So Amakings don't remove illegal content that was brought to their attention 2-3 weeks ago, what should namecheap do then? You think they are within their rights to suspend it?

They most likely have a clause which covers that.

I'm just playing Devil's Advocate here, I don't actually think that is necessarily the cause of this suspension. If it was, and the copy of the email posted above is true, then other Amakings domains would be effected because of the illegal content, and they would be suspended.

I was talking about 24 hours, not 2-3 weeks...thats different, obviously.

TheStout 04-07-2010 07:34 AM

Oh man that is pretty lame. I got an emo site for you guys in Beta if you want to test it out while they get their links sorted.

gleem 04-07-2010 09:15 AM

holy crap, you can just send namecheap DMCA's for AMAKING content he ripped from other sites and they gank the domain? wow... how the fuck did SG pull this one off.. guess that's what happens when you create a site from other people's paid content!

This tactic should be applied to tube domains.

only asshole registrars would do this when they feel threatened, namecheap I see is always willing to yank domains, maybe godaddy as well.

Actually, the most professional registrars would do this. (they are very anal about the laws)

I know NetworkSolutions did exactly the same thing in the past. Moniker.com too. Goddaddy isn't even worth mentioning.

well I know for a fact that Namecheap has seized domains with no notice at all to the owners until after the fact, if you do a search for older threads you will see case after case of this, as well as tactics to try their hardest to not let you transfer out domains, which has improved over the last few years, but when I used them as my main registrar I had a nightmare of a time getting my domains away from them.

This issue has nothing to do with content, and everything to do with trademark.

NaughtyRob 04-07-2010 10:21 AM

Although I don't agree with amakings stealing other's content, I also no fucking way agree that domain infringes, not even close to suicidegirls

I was talking about tubes.

But anyway, clearly NameCheap took the domain offline because of DMCA notice. I doubt they received the court order papers, ruling in favor of trademark infringement.

ShellyCrash 04-07-2010 11:51 AM

You guys are right. Looks like it's about alot more than just the use of the word "Suicide".

If there's ripped content and using the trademark "Suicide Girl", really can't blame SG for this action.

Doubt it - those girls in the 3 - 4 links aren't SG girls - they'd have swapped out the content immediately
Namecheap wouldn't have rolled over on that, it'd be for trademark.

I don't understand how anyone can put promo content from sites that admit to not buying their own content on their own sites. it's on thing to send em traffic, which I don't condone, but at least you aren't legally liable for links, but putting that content on your site isn't a good legal decision.

Far-L 04-07-2010 02:28 PM

I can't believe this needs to be explained but here goes...

They are not trademarking the word "suicide". They trademarked the term "suicide girls", and, yes, saying "suicide gf" could easily be mistaken. In fact, this thread would probably be used in court to prove that everyone here knows what inference is being made from "suicide gf".
