Um...... you contact vBull with actual legal copyright complaint, and then they tell the host to remove the software per violation of T.O.S. in regards to using their software for illegal/copyright.

I have not looked at their T.O.S. in the past couple of years, but I know that used to be in there. I am not sure why so many are lazy and apathetic in getting this handled. vBull does (or used to) enforce this, just as they enforce their own licensing renewals.

So they contact your host, just like they do when your license expires, and serve you with papers to remove their license or renew it. So your host forwards on to you, typically you have 15-30 days to prove or renew, and then it is removed.

If your host doesn't give a shit that you're hosting a massive piracy forum, do you really think they give a shit if you are using pirated forum software?

One thing I will agree with you on. IQ69 is made up of a bunch of piracy profiteering scum. All their most prolific members run huge rapidshare forums...

I don't know that I'd ever want to run such a "grey area" business model. To keep legal you would spend all your fucking time taking down links.

But I guess most of the folks who run boards like that aren't all that interested in legality.

Anyway, like I said I stumbled over it while looking for something else so I thought I would sound an alert, hate to see content all over the fucking place like that.

I have went through those steps before man. So I know. Including faxing complaints to their registrar, hosting, processor, local law enforcement, FBI and Attorney General of their State. I also have a couple forums with vBull licenses. So I know their process.

There is absolutely nothing I love to see more than someone based in the U.S.. Especially those who think that hosting off shore will protect them legally when they live, and are incorporated here.

Now, the problem with this issue is. Few want to spend the money to go the distance. They hire RYC to send DMCA's, which he just pisses on. They do not follow it through to the next step once/repeatedly refused. They do not file a lawsuit.

You see, most of these guys are gamblers. They are gambling you will not find your content there. You will not DMCA them. You will not take the next legal steps. Most of the time, they are right.

So they are playing a high stakes gamble to see if you fold, or will spend the money taking them to court. Which most adult companies do not. They just rattle the sabre at these guys or bitch on message boards daily.

I mean, even the big adult companies do it. Open up any issue of XBIZ and you will see some company(ies) settling out of court instead of going the distance on these copyright/tube/forum lawsuits.

I can assure you if people would follow through on the paperwork, filing your copyrights, and spending the money to sue some of these guys into oblivion (since you know damn well most do not have LLC's in place), then you would get some results.

Instead, they just bitch on message boards daily. Even with the host is in their own back yard. The victims could actually see some results if they would follow through pm sending some docs to a few key places in their state.

The forum own and hosting company are both located in the United States and within the reach of the Attorney General of California, as well as law enforcement of California. So if someone has content there, they can easily enough escalate the removal process and sue, since it is within United States. People can easily enough run a search on IQ69 for the rest.

I have no dog in this fight. I was simply answering JewCat and that if people are actually serious about handling things, they can do it easily enough since owner/host are within reach of U.S. laws and enforcement.

Furthermore, I provide the recommendations for anyone who wants to escalate such an issue based on my own success doing so when the offender is based in the United States.

Well I am very pro-active with my DMCA requests, so I doubt anyone will have luck attempting to sue anyone. But in the event that one of my customers is not responding to DMCA requests, they can be sent to me personally at [email protected] and I will make sure they are verified and action is taken.

To be fair this was probably close to a couple years ago now, I don't know how he rolls now.

But, there was a point in which I was promoting a certain sologirl site and was holding primo position on Google, the SERPs danced and sitting right beside me was a Shooshtime thread offering pretty much everything the surfer could ask for. As I said, I really do not know the back story on most of the people from IQ69. I received an invite to the forum last year, and have checked it out here and there over that time. I have been more active lately, but I do not know about all that madness.

I got banned ages back for bringing up the topic, spend a bit of time around there and look into the who's who. A lot of big forum webmasters there. Some not so bad, but also a good number of major offenders. Most of the big guys there built their initial traffic with video sharing type sites. hell, iQ69's owner Kaktuz is probably the worst. Never said you need a court order for any content to be removed. We comply with all legal DMCA requests. But, you are living in an ignorant bliss if you think an upstream provider will cut off a major source of revenue over a DMCA request. If I have a valid argument that the content in question is legal, they will merely reply for you to continue up your chain of legal recourse in having someone remove content.

Well I, again, can't speak to all the guys or board owners over there.

I can say I typically enjoy the business atmosphere with the exception of one or two people bi-polar/maniac depressive nut jobs.

But I do agree with you in finding it funny how one in particular tries to pretend his is any sort of professional on this forum, and his persona on the other is the absolute complete opposite.

i got banned for bringing it up as well (shoosh), I even sent 25k uniques of traffic to one of his sites (was a requirement to get a plug back) but never got the chance cause my account wasnt available anymore.

I go right to the hosting company with illegal content complaints. Having illegal content, especially adult content is a threat to their entire operation. The government can and has walked into hosting facilities and blanket pulled the plug. They can't risk that and if you can show any minor proof at all that it belongs to you, they'll yank it down fast...

That is, if you're dealing with a US company :P Good luck with some places over seas!
