Sexylicious.com + Canadian Trademark
 

Good day,

Years ago I ran sexylicious.com with all kinds of plans to expand etc. I ended up drifting away from the adult industry but still own the domain + the Canadian Trademark on the word Sexylicious. I tried to get it in the USA but SexAlicious was already registered and the Trademark office said it was to similar but if I wanted I could appeal with legal counsel. I did not pursue it.

So I'm curious as to what you all think the worth is of sexylicious.com + the trademark that "may" be argualble to a further trademark in the US as well as the other domains listed below. I'm sure someone with more marketing experience that me could do something with it.

I'm a little confused, when we submit trademarks in the US it's a paid submission process. And then we hear back in writing. I don't understand how you could have learned prior to a submission that it's confusingly similar to a live mark. Plus a search in the database shows a SEXYLICIOUS mark originating in Canada as currently abandoned and dead since 2008.

This one was a fun one to look up.

The LIVE mark for SexAlicious has a very specific use: A soap product enhancing sexual intimacy.

It reads:
Non-medicated skin and body preparations for sensuous skin care and enhancing sexual intimacy, namely, flavored or fragranced bubble bath, body lotions, body creams, body oils, body gels, body sprays, body dusting powder, lip balm and lip gloss; kits comprised of one or more of the aforementioned items.

I was able to secure a Canadian Trademark for Sexylicious as Canada has a separte system. I then paid for it to be looked at separtately in the US and was notified through the US office that they would not allow me to register in in the US as SexAlicious was already registered. I abandoned it in the US.

I agree and surprised it was rejected especially as its 1 letter different and more importantly isnt a soap product ......

or did you try to register it as a simlar subject/product. ?????
