iPhone App = Content Theft

This morning we were notified about a couple of iphone apps using our content...all are from the same company. Upon looking through these apps, we found lots of stolen content from other popular models as well. You guys may wanna check them out, they're certainly profiting from these apps:

Fuck a DMCA, this is Apple we are talking about. I'd turn it straight over to a lawyer ASAP.

SNRProductions 02-02-2010 05:28 PM

Oh man, now we're going to have to figure out how to get stolen content from apps removed. Ugh.

I can tell you that as an app developer and a lawyer, Apple requires that the developer to indemnify and defend them against any potential copyright infringement.

Here's the clause in the developer agreement...

Quote:

To the extent permitted by applicable law, You agree to indemnify and hold harmless, and upon Apple's request, defend, Apple, its directors, officers, employees, independent contractors and agents (each an "Apple Indemnified Party") from any and all claims, losses, liabilities, damages, taxes, expenses and costs, including without limitation, attorneys fees and court costs (collectively, "Losses"), incurred by an Apple Indemnified Party and arising from or related to any of the following: (i) Your breach of any certification, covenant, obligation, representation or warranty in this Agreement, including Schedule 2 (if applicable); (ii) any claims that Your Application or the distribution, sale, offer for sale, use or importation of Your Application (whether alone or as an essential part of a combination), Licensed Application Information or metadata, violate or infringe any third party intellectual property or proprietary rights; (iii) Your breach of any of Your obligations under the EULA (as defined in Schedule 1 or Schedule 2 (if applicable)) for Your Licensed Application; (iv) Apple's permitted use, promotion or delivery of Your Licensed Application, Licensed Application Information, metadata, related trademarks and logos, or images and other materials that You provide to Apple under this Agreement, including Schedule 2 (if applicable); or (vi) Your use of the Apple Software or services, Your Application, Licensed Application Information, metadata, Registered Devices, or Your development and distribution of any Application.

Yes, these apps are in the app store under the "lifestyle" section....where a few of them are in the top ten or have been in the top ten.

Michael, we def wanna talk to you about this.

Abbie 02-02-2010 06:56 PM

Oh and the guy responded to me (i contacted them via the contact form they had):
Dear Abbie,

Thank you for contacting us regarding the content of our application. In many instances, it is not always practicable or feasible to determine the ownership for all the content. That is why we provide a notice form accessible from each unique image.

Naturally, we stand ready to negotiate any reasonable, non-confiscatory royalty pattern for material that you can demonstrate is owned by you or your company. Can you elaborate as to which specific images you are referring to? Also, what kind of royalty pattern did you have in mind?

We sincerely apologize if we have infringed upon any content you own and look forward to working with you towards a speedy resolution.

Kind regards,

Michael Bosch

I have yet to respond and will go to the expert (coughmichaelcough) on that.

Who knows. All i know is that I have had to purchase his damn apps just to find my content and waste my time (and im still not done) and my employee's time going through all of this crap while he's sittin back bankin on it.

Fucking waste of my time. Steven actually emailed him to ask for a list of all the pics and videos he's using hehe...like he's really gonna help build a case against himself. *smirk* Would be nice though.

I'm slightly annoyed and grumpy today

I'll give u a call sometime soon...because i miss your charming voice.
