100% not legit.

We did not authorize them to steal porn.com content.

A lot of these Rapidshare blogs don't qualify for DMCA protection because they claim to not upload the content themselves and only index links available on other sites, but if you actually download the content many times the rar file the videos are packed in include a text file with the site's address. It's kind of hard to argue that you didn't upload the content when there is a text or other file in the rar file saying "Come to Pornlove.org for free porn" or something similar. I'm downloading something from this site right now to find out if they do it.

A few weeks ago someone was complaining about seaporn.org and their content being shared on there. On the bottom of their page they have this..."Disclaimer: This site does not store or host any files on its server. We only index and link to content provided by other sites." But if you go to any download link you will see otherwise. Here is the download like for a Mason Moore Manojob scene http://rapidshare.com/files/32917642...eaPorn.org.rar it has their website url in the link. When they packed the video in the rar file they had to name it that themselves, that is not something that Rapidshare does. Now if you download that rar file and open it the video is inside, and there is also a file with a link to seaporn.org packed with it. Kind of hard to claim DMCA protection and that you are only crawling links from other sites when all the evidence is there that you uploaded it yourself. They don't even have a section for a user to register so they can't claim user uploads.

I've seen a few of these sites that even watermark their site url on the stolen content. That is as fucking brazen as it gets...

I just downloaded a video and there is a shortcut to pornlove.org packed in the rar file with the video, so they can't claim DMCA protection. They don't have an option for a user to register so they can't claim a user upload, and they can't claim that they just indexed the link from another site because their site URL is packed in the rar file with the video...

Correct

If the forum/blog is moderated in any way that voids out DMCA loop hole you are referring to that applies to search engines and ISP's. Their well documented argument is that the spiders index material, and there is no approval process or moderation.

Same as that site that was in the news a few years back where women complained about men they dated and wrong scathing nastiness on the site that some dude was pissed about. The issue comes down to moderation.

If the site owner approves, or moderates, in any way. They do not have any DMCA safe harbor protection. Watermarking stolen content is a slippery slope. However, it is always nice of them to stamp it so you can track it back to the source and show examples in lawsuits.

did you even read his post?

Agent 488 01-04-2010 01:01 PM

not true. youtube moderates and deletes videos all day long yet still complies with dmca.

you are confusing it with online libel laws.

I was talking about "safe harbor" (Google/ISP) versus DMCA. Specially in regards to exclusion from DMCA take down requests. Sorry for confusion.

Bet anything that SeaPorn.org and PornLove.org are operated by the same person...similar style domains, similar Alexa graphs, similar sites and similarly including their URL in the rar files. I bet there's probably a bunch more of them too.

Agent 488 01-04-2010 04:51 PM

man there are dozens if not hundreds of the similar copycat sites - obviously ran by the same gang, upselling the same site ....

HomerSimpson 01-04-2010 07:11 PM

VideosZ and LiveJasmin ads are on the site?!?!?

DVTimes 01-04-2010 07:19 PM

No problem VideosZ should simply remove there account and not pay them and post the address of the persons behind this site.

Surly it should be standered of all TOS that if you promote pirated porn then you would not pay them.

if webcam and other sites were to do this, such sites would make no cash.

xp-ViT 01-05-2010 03:57 AM

I wonder: why program owners don't abuse such sites? it seems to me that if you send abuse to domain registratar and hosting provider some of them may react, what do you think?

ya most of my clients would shut off streams of revenue in a recession too.

get on the money side, not the crying/bitch side of this business.
