Shooting porn should be legal.
 
Just so ya know, if you ain't in California or New Hampshire, you're guilty of pandering. In my home state of AZ, that's a class 6 felony. :(

If you pander to someone or to their wishes, you do everything that they want, often to get some advantage for yourself.

Examples:

- He has offended the party's traditional base by pandering to the rich and the middle classes

- Books which don't pander to popular taste.

That is a slippery slope.... no pun intended. However, prostitution would then have to be legalized.

Its not only the criminal aspect producers have to be worried about if shooting outside CA or NH, its whether their model releases/contracts would be valid. You cannot contract for an illegal activity. Producers outside of CA or NH have to be concerned whether their model releases would be held up in court if a model ever decided to file a lawsuit challenging the release.

I doubt if prostitution would ever be legalized throughout the US though.

I am in AZ, been reported to the police that we were shooting porn in the backyard, the police showed up on the door step and asked if we were shooting porn. He also said we were breaking no laws, it was legal what we were doing as long as all parties were over the age of 18.

Of course I was shooting solo girl and not BG....but who knows.

Seems we had a snoopy neighbor...they shouldn't have been looking over the fence :2 cents:

No - read the description of "pandering" in your state law. In Colorado it's basically the arranging for others to have sex for pay. And here - it's looked upon as more of a crime than prostitution.

Solo girl is not the same as B/G. AZ is not porn friendly. I spoke with a webmaster in AZ that was being prosecuted for pandering for maintaining an escort website where he did nothing more than take and upload videos. All he did was maintain the site for the owner.

I would say you were fortunate.

Even here in LA, if a cop shows up at a shoot and you do not have permits for the shoot, said cop will usually write you a ticket for shooting without a permit (misdeamnor), shut it down and might take your tapes/content.

Here the law is pretty clear - if someone can see it - you are going to get charged with public indecency (as a minimum). Regardless of where you/they are. I guess it becomes "public" as soon as the public can watch.

Thank gwad my neighbors are all cool with it. In fact - the only one that can see into my yard enjoys the shows quite a bit.

That or prostitution - under Colorado law.

In fact - that's the current trend for "Johns" who think it gets them around the prostitution laws. Many POV shoots are nothing more than a guy paying for sex and filming it. If he has no outlet for the product - he's nothing more than a "John" getting his rocks off for cash = prostitution.

IMO - it would be a hard sell trying to convince a judge that it was anything more if there was no end product offered to the market.

It amazes me how many people think they can produce without a good attorney reviewing their business model, contracts, etc...

Sure - there are risks in any business - but understanding and managing those risks should be at the forefront of any serious business model.

Actually in CA and NH, POV shoots are also illegal. In the Freeman case, which protects porn production in CA, the single most important issue that the Judges discussed was the fact that the producer was not receiving physical sexual gratification from the paying the model.

Even POV shoots in CA arent legal.

I am aware that solo girl is not the same as BG and you do not need permits to shoot porn in AZ. I have never heard of anyone out here getting the equipment and images/vids taken when the police show up.

When you mention AZ is not porn friendly, can you clarify what you mean?

Was the escort site desert divas? If so, from what I have heard, they got what they deserved . They fucked up and are now paying the price for it.
