It is worth a shot on their part. But, now that it has national attention, no way Real, MS and AOL will allow them to take _anybody_ to court over this.
The large companies simply won't want precendent to be built.

Sounds like the firm might not be able to outlast a pooled defense by giants big enough to stall them legally and wait them out.

1.) U.S.P.O passes a broad vague silly patent.
However, no matter how silly was a patent is granted, it must be invalidated by a court through prior works.
(i.e. Amazon's 1-click shopping)
2.) Acacia buys patent for their portfolio of patents.
3.) Acacia seeks to enforce patent.
4.) Acacia seeks a weak target to bully into court and defeat to force them to pay. regardless of how silly the patent is.
5.) Acacia sees adult webmasters as good targets. Small and "quiet." With no industry lobby.
6.) Acacia issues C & D letters to smaller adult companies. (avoiding Hustler and Playboy...anyone they think has enough money to actually go to court)
Even though this is silly when you think about it. They are suing the immediary of a software product, not the maker (Real, Apple, MS).
7.) Adult webmasters actually get pissed and tell Acacia to fuck off.
8.) Acacia is readies a court battle.
9.) Aol, Real, Apple etc. are probably getting ready to knock the shit out of Acacia.
