ACCC takes Redhotpie owners to court

If you?ve been receiving more attention than usual on adult dating sites of late, be warned ? that potential special someone may not be who you think they are.

The ACCC has cottoned on to this and is now taking the operator of the redhotpie.com.au, Jetplace, to the Federal Court, alleging the company engaged in misleading conduct.

Specifically, the ACCC is alleging Jetplace created and published fictional profiles on its website and used them to send 'flirt' and other messages to registered users. According to the ACCC, Jetplace mislead users by representing that each and every profile was created by a person who came to the site and registered, and that any profile identified in a search conducted by a member would be member-created, when it was not the case.

Additional alleged conduct includes representing that every profile viewable on the website and every message received from a profile provided an opportunity for a member to socialise with, and potentially meet, the member who created the profile or caused the message to be sent, when it was not the case.

The ACCC is alleging that the directors of Jetplace, Mark Semaan and Maxwell James McGuire, were knowingly concerned in, and party to the contravening conduct. It is seeking declarations, injunctions, orders and costs.

The site?s owners bill Redhotpie as ?a sexy little internet site that grew from humble beginnings to become Australia?s sexiest online dating community for guys, girls and couples?.

The site's media pack reads? ?RedHotPie is about flaunting convention; the norms are smashed and daring is embraced. The Pie offices are perched squarely on the cutting edge and the door is always open to their beloved members; but let?s fire up the Delorean and head back to the start.?
