[BIZ THREAD] What would you do?
 
OK I was just talking to my sister who is an artist. She does various forms of paintings and sculptures and what not. About a year ago she was commissioned to do a small piece for someone. She went ahead, did the initial sculpt and sent it's mock ups to the client.

Fast forward to just recently. The client shows up out of the blue, says she is completely dissatisfied and wants a refund immediately.

Now here's the question. Isn't there some sort of form of limitation on clients coming back years later? Would it depend on contracts signed? Etc etc... What are you thoughts?

I agree totally. But how can you get that point across legally? How can my sister cover her ass.

Was your sister paid the full amount up front? Did she complete the job or only do the mockups?

If she only received a percentage upfront then i'd say stiff shit - your sister has material and labour costs. Even if the woman didn't like the work, she can't expect your sister to foot the bill.

Yes paid in full. She went as far as she could go with the job considering she needed input from the lady for the mock ups. When she asked for input the lady disappeared.

Well i'd personally work out my labour + material costs for the work done and refund the rest. Not a clue with re to the legal aspects though.

Tell the dissatisfied customer to get a lawyer. Problem solved. I think any lawyer would laugh at her.

Do nothing, nothing, don't even take anymore phone calls. Tell your sister to shut-up and wait for a certified letter. Until that happens the customer is just blowing smoke.

Stop talking to this person do not take calls, Tell her there will only be reponse from writen letters, Ask her to write down her reason for a refund etc. This will take the bullshit right out of it.
