Ok, some ideas (also for programmers):
 
This industry will not organize itself completely, some are some ways, but there is a demand and "market" for protection, better and easier ways to handle it individually, because most are on their own. Therefor, as I see it, it is the programmers who should make money on this "market" firstly - not laywers.

If you care about your business and content, then you should read on:

Protection
This is the most important part, in fact critical for many, and like stickyfingerz says; if you ignore it, you can only blame yourself. It is not what you do that matter most, but that you are actually doing something. Doing nothing, won't help you at all!

There are many things suggested, but I observed a suggestion regarding the "watermark problem" on the other sub-forum that drowned, and it needs to be repeated:
Place your logo or watermark into the scenes, and there is no way it can be ignored. Just like Payserve do, logos on t-shirts, arm wrists, background.. whatever :)

Another suggestion is to use the same principle as Hollywood do sometimes, when they release DVDs to reviewers; Place a fingerprint on movies and photosets, which is unique for each member. This is not impossible, it just need the right program developed (any programmers see the potential in this?). Then make sure every member signed up are aware of it for the preventive effect, and make it difficult to find and change for the identifying purpose.

Reporting infringements
It is difficult for programs and copyright owners to identify and keep track of infringements, but you can make it much easier if you improve the reporting methods and thinking.

Both your affiliates and loyal members have an interest in keeping your program converting and quality paysites. But if they have to go through a slow and difficult process to reach you, like email confirmation/spam filter blah blah blah, then it will probably not happen. So why not make it simple: Implement a reporting submission form in both your affiliate and member area. It's fast - and it's discrete.

REWARDS: If you really want to improve reportings - then give rewards. Whatever it is, like free membership for surfers or bonus for affiliates, it works, because that is what they love! And what can be better and cheaper than an army of surfers hunting for you?? :thumbsup

Identify and handle infringements
If you find infringements you already know what to do. "Unfortunately" you are not the law enforcement, but you have the rights to police the use of your content. Therefor you also have the rights to hire agents, humans or not, to do the work more efficient.

Besides the reporting mentioned above, any infringing websites should therefor be flagged and watched, and a software can partly do this automatically for you (again programmers?). You need something better than google...

Even more important, is that you act and show that you are watching, and this has to be done very agressive. It is not illegal or shameful show off your rights agressively - the more the better. And record it all - for later potential legal use.

This is just some few ideas to get things going for those who care. Any others? :)

I would add a few more items here

In the protection area, when you are having your editing done, have small 2 or 3 second black screens inserted into your movie on occasion and use them to insert text that is entertaining and provides a smooth transition. When you do this you can also add your site watermark.

For all of us we should be flagging users and IPs that are stealing our content and conveying those users and IPs to each other. Yes we would be turning down potential joins, but what is more important a couple of joins not taken that protects your members area from the content thieves or the number of joins you will get in return down the road when you content is once again only found in your members section.
